      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Ouch, the porcine Mr Pickles should have to manage on benefits say for 12 months to feel the pain. The problem is that many council and social housing, is also in band C or higher for council tax, making it unaffordable to low income families also.

 

Not very nice news at all PT In Wales where they have already been revalued this one will be a nightmare. Where I live the houses were rebanded from an A to a Band C

 

@ outlawla, it just proves that none of the politicians whatever party, give a damn about anyone who is poor or on low incomes.

So they want to cut down the help people get to pay something that they cant afford in the first place then send bailiffs out to charge them even more that they cant afford. They already do this and it dont work so what do they think is going to happen if they make more cuts to the help people need.

 

“This in turn would create additional costs in the short term relating to prison sentences, and in the long term with regard to the social costs of rehabilitating people back into mainstream society.”

So send them to prison which in turn will create more people that are going to struggle to get work because of a criminal record and also overfill the prisons that are already full which will cost more money that they will no doubt find by putting council tax up.

I will only make this comment.

''It is time that non payment of Council tax was decriminalised,

it is a social tax on all set at times at totally unfair and unreasonable

levels based on purely subjective rules and protocols.

It would be fairer to do away with the benefits system and have a local

income tax system which would not only be simpler but cosiderably

cheaper to adminster, and those who can pay more will do so those

on low incomes, benefits would not then be faced with a liability

order and costs.

For anyone interested in the Commons debate on the Clause 8 — Council tax reduction schemes, Labour MP for Alyn and Deeside, Mark Tami kicks off the discussion and questions how increased bailiff involvement can possibly help.

 

It is the people my hon. Friend has mentioned—those who are on the poverty line and do not have any spare cash—who will be in arrears with their council tax. Every day in our surgeries we see people who tell us that the bailiffs are about to arrive. How can the Government’s proposals possibly help?

Absolutely, how can they help, by sending bailiffs to a can't pay to empty the house, for arrears and bailiffs fees, then as they are on benefits load them up with Budgetting loan debt to refurnish? Community Care Grant ?, are not goods provided via a CCG not exempt from seizure as they will be essentials, ?

As I have said on here many times before.....we are facing the worst recession in living memory and local authorities are treating the public as CASH COWS.......

I have no doubt at all that things will become MUCH WORSE...

 

It will become so bad that items seized by bailiffs will be lucky to make 2 - 5% of value at auction imho

As Wolfie used to say "come the revolution", I can forsee more anarchy and public unrest as neither the Goverment or local politicians have a clue about the real world.

 

They live on another planet where everyone has a bottomless pocket to pay their extortionate taxes
