You are absolutely correct. I should have opened a new account before I started all this. I recommend to anyone reading that they do! It's my fault for dragging my feet. I was expecting to be accepted for another current account, alas no. I have gone for a basic account now.

 

I have had a nightmare with the pay day loans companies, they pretty much ignore letters you send and am only now getting responses from emails. Phone calls prove fruitless as I just get the spiel about I entered into an agreement blah blah blah.

 

It's quite exhausting. I have also had to make a formal complaint as one company kept ringing me at work despite me telling them 3 times not to.

I will always advise whatever the banks say the

only way to quickly stop these payments is a totally

new account some times preferably a different bank!

I seem to have gotten most of the CPA's cancelled now. Or so they say. The bank says I should be safe to put money back in account, they will refund etc.

 

Tomorrow is D-Day when all my priority payments must come out, mortgage, council tax etc. I am literally a wreck worrying if I will or will not see the payments made.

 

However I am naming and shaming a payday loan company called Swift Sterling. They are blatantly ignoring all requests (physical letters and emails) to stop the CPA. They are stating they will only deal on the phone. I do not wish to deal with this on the phone, I have no physical evidence of their dirty dealings then. And I believe they are definately dirty dealings. They also ignore requests to do with NOT being phoned at work. Complaint to ombudsmen submitted.

 

I have threatened them with the ombudsmen but it seems they really don't care. I have read somewhere that they state they aren't even under the juristiction of the ombudsmen?!

 

A complaint direct to ombudsmen with no messing?

The PDL's will ignore your request to cancel the CPA. Thats why you need to go to your bank, quote the law word for word and demand the bank cancels it. Dont leave the bank till its done and dont take no for an answer.

Well today was D-Day and guess what...... Lloyds made sure the PDL's CPA's didn't go through and all my priority bills got paid! Yay!

 

My advice from all this. Go straight to Lloyds Debit card dispute line and speak directly to them. Branches, letters etc have all failed. Number is 0845 3006699.

No it's not to late if you informed the bank that payments

were to be stopped .

After the payments were taken I rang them and said that I had not give permission for my debit card to be used. It was a new debit card! Natwest said that because I had once had a financial relationship with CFO, thatI had given permission so they could not refund the monies.

Yes, basically. They said that because a financial relationship existed they could not refund my money. This was nearly 18 months ago though. How would I even go about reclaiming it?

 

Natwest seem to be quite incompetent at dealing with CPAs froom what I have read!

They were ok with me after i refused to leave their premises when they were clearly breakign the law by refusing to cancel a CPA i had on mine. They even threatened to call the police and have me removed from a branch. I was there for almost 5 hours :D Yes, thats FIVE hours .

 

I told them that if they called the police, i would immediately seek legal action against the bank and the staff at the branch i was in as they were willingly and knowingly breaking the law themselves.

 

Around 15 mins before the bank closed, i was instructed by the bank manager there to take a phone call. It turned out it was a senior complaints manager from their head office, and the manager said that she had personally removed the CPA from the system. Took some doing, but i wasnt going to back down like they were expecting me to.

You can try but due to the amount of time thats passed its very doubtful. It would raise the question of why have you waited so long?

Banks are private companies. They act just like very other company and that includes breaking the law and lying. Look at barclays for example.

Because I only found out yesterday that they have been able to do it since 2009. I assumed they were telling me the truth!

 

If you only found out about it yesterday, that means you haven't sent by letter an instruction to cancel and anything done before that instruction is received is perfectly legal.

I don't think they are incompetent, I think they don't like being told what to do and want to try and stamp 'their' authority on the general public even if it is unlawful, it is their way of throwing their toys out of the pram.
