      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have just checked my account and found £8 left of my £1K wage. I rang my bank and found payday express had withdrawn £375!

 

I owe PE £450 i have an agreement that i repay £50 pm for the next 8 months, this is now month 3. Last month they took out an extra £12.50 and they refunded it 6 days after i flagged it but this really takes the biscuit they have wiped my account!! how am i to feed my kids and get to work with £8.93??

 

I am soo tired of the taking whatever amount they wish, they took out 8 lots of £12.50 and then a whopping £275 all in one day, how is this legal???

 

What can i do, im unable to wait 6 days for a refund. And i can't do this every month, why are they so incapable of taking £50 from my account pm as agreed.

 

Does anyone have any advice? I will be calling them first thing in the morning as their offices are closed this evening but found a number with a voicemail and left them a message.

It is NOT legal for them to do this, get onto the bank and get them to reverse the money. Use the chargeback mechanism.

 

Complain also to the OFT and Trading Standards

http://www.tradingstandards.gov.uk for Trading Standards

 

You could also contact the Daily Mail who have been running stories on Payday loan companies, they would love this story.

Don't call Payday Express - only communicate in writing so you have written proof which could be invaluable

Get new bank account (only way to prevent any further raids)

Request bank details for PDE and you pay them in future - Do not give debit card details

worse case - you can walkin and pay cash at your nearest Money Shop for Payday Express payments if you need to make future payments which is what may happen, should you claw money back from your bank

Report away to all and sundry

The bank claim they are unable to dispute the transactions because payday express are registered with the fsa.

I need the money back into my account asap but it took them 6 days last time and I cannot wait that long

Be really strong and firm with the bank, ask and make sure you speaking to someone senior (say you could take them the bank to the FOS as a complaint)

Can you approach a credit union? or ask employer for a small advance on next months salary to get you through

 

If it worked before then get hold of PDE tomorrow, perhaps their systems have failed them

please try and get everything that happens in writing

barclays, he told me to contact payday express if i get not further then to ring trading standard and report my issues to the FSA but i need the money back now not 12 weeks down the line.

Good news!!!

I rang payday express and actually spoke to an ok person

he advised me to go to their sister company "the money shop" with a bank statement which clearly shows there was enough money in the account to cover the £50.

 

Their excuse for taking out £375 from my account was that barclays denied their payments

so PE thought this was due to insufficient funds or/and they thought I broke my agreement

and thought hell we'll just take the lot instead!

 

i managed to get £300 back in cash from Money Shop

but PE are disputing the other £25 which I am happy to wait

and dispute by writing only and to of course arrange another way of paying as the debit card route is certainly not working.

Great news ! chuffed for you. Yeah I always found the men at PDE way, way better to speak to ever then any of the women... just follow it up in writing Moneyshop it on future payments or I have their bank details back in one my postings on this section for Payday Express (posted Dec 2011 time) which you could check thats still correct and use x

I have the bank details but I'm afraid they will still take the debit card payment as well as the standing order

because they are either that stupid or arrogant but most probably both.

 

They are totally refusing to put the repyament plan in writing and actually was quite rude,

he even said he was unable to guarantee this cock up wouldn't happen again yey!!

 

I'm half through writing my letter of complaint which I will send to PE also copying in Trading Standards and FSA.

I've already reported PE to Consumer Direct.

I've also ordered a prepaid Visa card which I am going to use solely to pay PE so they canno go over the agreed amount.

Write a letter to your bank instructing them not make any payments to PE. They have to follow your written instructions as detailed in the FSA guide. If you can hand it in to the bank it would be best, otherwise sent it to them by recorded delivery.

i have just tried searching for PE on the FSA register and they aren't registered, what the hell was my bank talking about.

 

I have looked into stopping re-accuring debit payments and they all say the same thing to write to PE and formally ask to remove the recurring debit payments, but what happens if they refuse.

 

The bank has point blankly refused they say unless i ask PE first and provide evidence to the bank that i have requested payments to be stopped

and PE again refuse they can put the payments into dispute which can then involve VISA

and is a very lengthy process which is leaving it open for PE to continue to take what they please.

 

The really annoying part is i have honoured all repayments and will continue to do so

but i would like a little more security and go for a direct debit or a standing order,

 

i will sign a contract to say i will not default.

Why don't you setup a standing order (only) for Payday Express? as you have their bank details to do so write and confirm that to them.

 

Are you in a position to change banks because this is another option - this way at least they just won't then have live debit card details - end of problem

 

Failing all this, check out your nearest Credit Union because I didn't realise some can provide pre-payment cards to use (and I bet it will be much cheaper then ordering one through an online service)

its funny you say that i have just applied for a pre paid debit card think im going to give payday express this card so they don't take my family budget account.

Get a letter sent to your bank instructing them not to make payments to PE - they have to comply. All you need to say is

Dear Sirs, Account No:XXXXXX

"Please act upon my instruction not to make any payments from my account to Payday Express effective 3rd February 2012".

letter typed up and sent via recorded delivery to BARCLAYS bank stating they MUST stop all debit card transactions to Payday Express due to unauthorised transactions on my account. Also letter done and sent via recorded delivery to Payday Express with an extract i enjoyed writing: I would like to make you aware I have sent a copy of this letter to Trading Standards and FSA. Please be aware of the complaint procedure time guidelines. If these instructions are ignored I will be forwarding my complaint to the Financial Ombudsman.
