Can I Make a PPI Claim After This Long?

Hi all,

 

I took out a loan sometime in late 2002, early 2003 with Sainsburys Finance.

 

I then moved abroad in April 2004 but left approx 2-3 monthly repayments worth of money in my UK bank account to cover the loan while I sorted myself out.

 

Around June/July of 2004 I contacted Sainsburys Finance and asked how much was outstanding on the loan, I was told and paid it direct to them via a Swift Code from my foreign bank account, the loan was closed.

 

Being as it was so long ago, I am having real trouble remembering any figures i.e. how much I initially borrowed & how much I paid in one lump to finish the loan and all the paperwork relating to this loan has long since gone.

 

I am now back living in the UK but have since changed my surname, if that may cause a problem.

 

I am pretty sure that when I applied for the loan via telephone I was told that insurance had to be taken out as the loan would be turned down otherwise.

 

As with most other people a courier brought the cheque late one night along with the agreement which I had to sign there and then, a bit of a rush setup so no time to go through the finer details.

 

Any help would be appreciated.

yes there is NO TIME LIMIT on PPI

regardless to what those diddling tv adverts claim

 

first port of call would be an SAR to sainsburys finance

 

give your old name, proof of who you are now[util bill will do]

 

any any old addresses you might hVE LIVED at too.

A couple of questions though, what is an SAR and is there a specific address for Sainsburys for sending a claim to?

SAR - Subject Access request - It is a data request for all of your financial history with a company

 

You would send the initial SAR to their Head/registered office. - You need to enclose a fee of £10.00, send it recorded/special delivery and keep the receipt and check that it has been received.. by visiting the RM website.

 

The company has 40 calendar days to supply you with the data.

I made a successful PPI claim from Sainsbury's bank last year. It is actually HBOS who deal with these claims. I sent the SAR to Sainsbury's bank and got a reply from HBOS. All further correspondence was sent to HBOS, PO box 791, Leeds, LS1 9LR.

Also is this the address that you used to contact Sainsburys?

I saw that the £10 cheque that I sent with the SAR request had been cashed through my bank today, so I was expecting some kind of activity.

 

Then the post arrived and I had a letter from HBOS.

 

It stated:

 

"Unfortunately the details you have supplied have proved insufficient for us to locate you on our systems. Please reply to us with further information; account number(s) and or previous addresses. We will be unable to process your request until we have these."

 

Now in my SAR request that I sent them, which has been sent back to me, I made it quite clear in bold type directly underneath 'Dear Sir/madam', my name at the time of the loan and also my address at the time of the loan, which I know to be absolutely correct!!

 

Could it be that they didn't see that information?

 

As for the account number(s), I have no record of this as the loan was taken out in either late 2002 or early 2003 and any paperwork relating to the loan has long since gone.

 

Also in the letter they sent to me today it states:

 

"Please note, HBOS are not obliged to supply records held in paper format if they do not form part of a relevant filing system"

 

What the heck does this mean, are they trying to get out of fullfilling the request?

Write back to them and reconfirm your details.

 

Also mention that they have cashed your cheque and as far as you are concerned the 40 days clock is ticking. Mention that if you do not get your data you will be filing a complaint with the ICO.

What you are looking for is either a copy of the loan agreement or any docs that tell you the breakdown of the loan when it was originally take....maybe the first statement?

i have the credit agreement.

 

It says : Sainsburys Creditcare Bronze = £2194.80

 

When i paid this off i was given a rebate of £876.57

 

So i make the difference £1318.23

 

The first payment made was 06/02/2003, The last payment before settlement was 07/06/2004, the settlement went through (as it was foreign bank transfer) 14/09/2004

Have a read of No.1 in my signature...it will show you how to prepare a claim and use the spreadsheet at the end to establish what is due back to you.

 

You will need to send a copy of the spreadsheet and a completed fos questionnaire (available form the fos website) to the lender with a letter requiring refund
