      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

After 3 months of emailing PDE asking for a repayment plan, and the constant telephone calls to my home, mobile and indeed to my work - which I complained to them about, they have now come back asking for a I&E form. Do I have to send one. I offered what I thought was reasonable but I dont see why they should have see what income and expenditure I have.

 

BTW on default day due to the fact I did not have a chance to cancel by direct card they tried to take the full amount out 23 times:jaw: Needless to say there was only £1 in the account so it was declined. Got a new bank card. Bank say it is disgraceful behaviour and I have reported them

Well, tricky one. You don't have to provide proof of your income and expenditure to them. Only a judge can order this.

 

However, they sent me one also. I filled it out and sent it back to them. They then emailed back saying they couldn't open the file.

 

So... I didn't bother sending it again. My dmp told me not to. Said that they'd just pick at it and tell me to cut down on spending, sell my car, move into a garden shed etc etc.

 

The choice is yours though. What harm can it do? If they do pick at it... Just tell them 'they're my details, they're not negotiable, like it or lump it'

 

Would be good to get these shysters off your back huh?

Don't fill in their I&E form, simply put, they are not entitled to one!!, I'd be amazed also if they are using a court authorised version either. They have no legal or regulatory authority to demand this (although they might think they can or even suggest they can via suggestive wording), ask them how they can request this and what grounds entitles them to this information?

 

Send back a simple statement stating

 

Income xxx

 

Priority debts (rent/nortgage, council tax, gas/electric, tv licence, phone etc xx

 

Don't list other creditors, provide them a single amount.

 

The Balance? I'd suggest taking off a few quid each month to cover emergencies

 

Be careful with these people, they tend to be fairly ruthless if you provide any information that they can use to screw you over more than normal.

And did you eventually get sorted I take it with the lender in question?

even after all this time! blimey I think they would have had me in the nut house long before now if I had to still deal with them ! I didn't get the option to do one of their income and expenditure forms but they certainly treated me to an entertaining call with their 'hardship team' in the end !! but I've gone through scared and I think it's turned to anger & frustration, that only a judge can solve.

Haven't had the "pleasure" of the hardship team yet, although I would think it's only a matter of time!!

 

Hats off to you achieving level 2 of "anger and frustration", it's somehow more self satisfying than being scared of the post/phone ringing with idle threats from these people and feeling your just a parasite to them. I took some cracking advice from the forumista's on here, along with CAB, as soon as you take control of the situation, ask the awkward questions, you feel so so so much better!!
