Hi Moses here!

Please can anybody explain,very simply, what you do once you have received some but not all of your statements and you have sent the letter telling them they have 7 days or you go to court?I have looked through the FAQ's & other threads but can't seem to get passed the above letter. I have read that if you have some statements you can estimate back for the outstanding years but that was when we had most of our charges & there aren't too many on the statements we've received.

Do I need to personally go into court as I am in Spain which makes it a tad awkward! or can it be done on-line?

If they haven't sent you your statements this is a breech of the Data Protection Act and is a matter for the Information Commissioner, they can be found here ICO – Information Commissioner's Office this is where you need to log your complaint.

 

Yes you can take them to court online. at "MoneyClaim" that is the online version of the Small Claims Courts.

Hi Moses,

saw your post in another thread.

You do need to add in the interest in the total charges claimed box on the MCOL form. However i didn't but the halifax still paid me the full amount including the interest

thanks for replying still filling the claim form out been in front of this screen nearly all day(but am trying to make several claims all at different stages) good job i've got some good music to listen to or I might have gone totally bonkers:rolleyes:

 

how far down the line did you get before halifax paid out.

When did you inform the courts of the costs incurred i.e court fee , DPA fee ,recorded delivery charges etc..
