I am claiming for both a joint and business bank account, both of which are over £5,000, although I haven't put in a claim as yet for the business account as I am still adding up the charges (£8,000 ish so far!).


I issued the second letter (LBA) ten days ago which my husband handed in to the bank. He was asked what it was about (as it was addressed to the manager) and when he told the clerk, he was advised that all charges are being upheld.


Needless to say, I have not, as yet, had a response to my second letter. I am therefore presuming that I will have to issue the action but am not sure where to send it and which court to put in.


Any advice please? Thanks so much in advance.

You can either go to your local court and file a claim there,or you can do this online.Go to WWW.Moneyclaim.gov.uk This will enable you,once registered to file your claim.You may have to file the claims separately due to the amounts being over £5000.These will be put into the fast track part of the court procedure,and the fee is higher.You can,if they decide to defend, request the judge to keep the claims in the small claims area.

Don't forget to go through every charge and add any compounded interest.Some people just add the 8%.. but you can only do this at the court stage.

Well here I am several weeks down the line having filed my MCOL for around £7,500 (including interest). I have received the solicitors letter today from HSBC asking for a breakdown of the charges. The 28 days is up on 8 November. Is this a way of the solicitors trying to extend beyond the date for judgement? I will be giving them the figures by letter today.
