I've had a Burtons Store card for some time now. It had been used but was no was not near its 650 limit. This was over a year ago and I haven't used it since, I've just been paying the minimum (yes I know not a great thing to do :!: )

Anyhow I received a letter from these guys a week ago letting me know I had gone over my limit by around 150 which I was surprised at. I checked my statements and it does appear I've gone over due to charges placed on the account. I notice it had been standing at around 550 when suddenly the minimum payments were obviously not stopping the amount from increasing and thus my current situation.

 

Currently on a course I can post up details from the statement later if it helps (i,e dates and charges.. not account details obviously!)

 

Looking at where to go with this as I don't believe I should be getting charged this extra amount as I had been paying them in good faith with no missed payments and was never at the actual credit limit on the card. :mad2:

hello wkd blue, santander administer these store cards and hence cannot control the charges and the fees levied. pls contact the burton number on th back of ur card as santander wudnt do anything about these charges except th late payment ( which u obviously never had)

Hi

 

The credit for Burton Store Cards is provided by Santander Cards UK Ltd. and it is they who you should approach to obtain a refund of any charges.

 

Late payment fees and over limit fees are all up for grabs plus interest as the charges are deemed unlawful

santandy manage the financial account, the store merely sell the products and ges their money from the creditor immediately, thats where their involvement ends.

Cheers ims21 had a read. I'm thinking it's best to start of with a preliminary letter to them? Before going down the route of CCA, SAR would this be wise?

 

I've got the latest statement which goes back to 2010, managed to create a pdf minus account references :-) Could someone have a look at it for me? Account from what I can tell was reducing Aug 2010 (albeit slowly) and then for some reason the payments I made were not enough? Must be down to charges, I just don't know what changed with the account!

if you've not got all the statements you really should sar them.

 

you need to put in two claims

 

one for penalty fees

and

one for their spoof PPI

 

they will write back and tell you its not PPI

they will say its something else - and not covered by the FOS/FSA PPI ruling.

just call their bluff and they will cough.

 

you need to use two copies of the attachment ive sent [1 PPI and one for penalty fees]

this is called an SOC [schedule of charges]

put THEIR latest int rate in cell D15 of each

 

then fill in the three columns for EACH item from your statements

 

PPI CLAIM

get a copy of the fos customer questionaire from here:

fill that in and post it off with your PPI SOC

and a covering letter

 

PENALTY CHARGES RECLAIM

Charges SOC + covering letter

 

if you dont do it properly

they will short change you and wriggle and wriggle

Ok I'll send off the SAR first and wait for a return on that then do the other stuff you suggested.

Thanks :) Had a friend just take a look at the statements I linked and here's what he said

 

well, not sure what info you need, but looking at this, your minimum d/d payment has consistantly been 4% of the balance every month, up to and including 12 dec 2010. from 11 jan 2011 onwards, it dropped to 1% of balance! thats nowhere near enough to cover the interest, let alone interest and balance protector cover. did you ask for the DD % to reduce? cos im pretty sure they shouldnt do that without you asking! theyve dropped it to a level that means you will never pay it off, always debiting more than you pay each month! a drop of 3/4 is huge! deffo grounds for complaint if you didn't ask for this change.

 

curious as to why it reduced!

Never asked them to and haven't been in touch with them since the account opened as never needed to!

Nothing received in relation to SAR's request however received another letter off them demanding the outstanding :mad2:

Hi

 

 

Have you been defaulted on the account? If not, and to avoid a default, I would continue to operate the account normally if you can and then hit them with the charges and PPI claims when you have received your SAR information

Just after some clarification.

 

I'm still awaiting information in regards to my sars request.

 

Santander are still sending letters out asking for the amount the account is over by.

 

Obviously as far as I'm concerned they have caused this as I have never missed any minimum payments.. as such as far as I'm concerned the account is in dispute.

 

Can I ask them to freeze the account until this dispute has been sorted?

 

Or do I pay the amount outstanding and then claim it back along with the ppi and interest once I calculate things when and if I receive the sars information?

I have continued to pay the minimum, my question was really in regards to paying what they say is outstanding even though they have caused it. Minimum payments as I have said have never been missed. It's just for some reason the minimum stopped being enough to keep the account under control, I'm guessing due them messing with the apr or some such.

There has been movement!

I received a nice amount of paperwork from Santander, hopefully I can now move forward with this!

 

This first pic is just the introductory letter

Second is Credit Agreement, so I'm guessing I can skip chucking a cca request at them. Thing with this though is I've noticed I seem to have signed for Account Protection :( I'm still going to have a crack at a PPI claim though. There was no reason for me to take it out at the time due to my job being extremely secure. Hence why none of my other loans/cards have any form of PPI on :|

You need to go through the transaction history and identify any late payment/over limit fees and enter them on this spreadsheet. Use the interest rate they were charging on the acount unless you want to go for a higher rate of interest in restitution. You would need to sue for that. Have a read of No.4 in my signature.

For your PPI claim, start a thread in the PPI forum as the charges claim and the PPI claim are dealt with as two distinct matters

So I sent off a letter to get the PPI payments back and finally received a letter:

Where do I go now with this?

 

I also need to reclaim charges they applied after screwing up the account as have never missed minimum payments. Although they did something to the account which took it over its limit :mad2:

For the PPI, what were the reasons you gave for the mis-sale?

 

Next step is to challenge them over their findings.

 

With the charges you need to prepare the spreadsheet as previously advised and send them a preliminary letter and copy of the spreadsheet requiring refund. The template for the prelim letter is in the CAG library, top left in green.

i have removed the image link as the photo album as it shows per photos.

 

if you need to post docs etc

 

use:

 

 

scan the required letters/agreements/sheets - as a picture[jpg] file

don't forget you can use a mobile phone or a digital camera too!!

.

ENSURE: remove all pers info inc barcodes etc using paint program

but leave all figures and dates.

goto one of the many free online pdf converter websites

it would be better to upload a multipage pdf if

you have many images too rather than many single pdfs

.

or if you have PDF as an installed printer drive use that

or use word and save as pdf

.

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

Reposted the picture as requested although done a different way as I couldn't find the attachment option.

 

I simply told them I had been encouraged to sign up[ for the PPI to be accepted for the loan. That I wouldn't normally take PPI on and haven't with any other credit due tot he security of my job.

 

Miffed they chinned me off, I still need to have them for screwing my account up and get charges back.
