      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everyone, I'm a new user here but I can see a lot of people in the same situation as myself. I've got myself in a right pickle with 3 payday loan companies:Payday uk I owe £437.50 Payday express I owe £400.00 and here's the biggie..Wonga I owe £850.00. Purely through my own stupidity which somehow makes the situation worse :( I haven't told anyone I know as I'm so ashamed of myself. I also know they are in no position to help me so there is no point causing them any worry. So it's great at least to have support on here!Obviously this is rinsing my wages and I'm not paying anything off! It's getting to the point where i have nothing left once I've rolled them over and paid the interest charges! It's been causing me many sleepless nights, I know a lot of you can relate to this. But I must say that all of the advice on here has been brilliant and I have just today contacted them via email to try and arrange payment plans.I have offerred each of them £100 a month, which I hope is reasonable. Well, it will have to be because I can't afford anymore! But thought I would keep you all updated, and any advice dealing directly with these companies would be gratefully received!!!!Guess now I just have to wait for their responses. I'm trying not to hope for too much. But I'm not going to give up!

Hi there! Well done for coming here.

 

Be carefully with that offer of £100 per month. Some of the lenders may consider that as an interest or rollover payment! For the 2 smaller loans with payday express and payday uk, the £100 would cover the interest.

 

I'd certainly get a payment plan from them in writing before making those payments. I'd hate for you to think that your balances are decreasing by £100 per month only to find out that they're staying the same.

 

Work out what you can comfortably afford to pay them and get it in writing!

 

Have you followed all the advice here about cancelling bank accounts and cards?? If not, watch your account! As soon as you notify these companies of problems, they get busy trying to get their hands on your money.

 

Be prepared for a bumpy ride. There's no point in sugar coating this. I'm in the process of doing what you are about to do! Whilst it hasn't been easy - caggers have been beside me every step of the way and offered some amazing advice and support.

 

Paydayexpress will tell you that they only accept repayment plans if you're deceased (lol - a few other things, redundancy etc) just keep firm with them and offer them what you can afford. Make token payments to them whether they accept your offer or not! They can not refuse them. Try getting their bank details to set up a standing order or send them a postal order recorded delivery.

 

Please, let us know of any responses you get!

 

The general rule is, don't speak to them on the phone!! Although - some here have said they've had some luck with talking to them on the phone. I personally keep everything in writing to ensure a paper trail.

Your doing the right thing, going into default is the best thing that can happen as some may not deal with you until payment would have been due, (though I don't mind being corrected!) can you also change your bank account as 99% of these will follow through with what they say like they will still try for payment on due date. Basic accounts are easy enough to open and can be done online today to.

 

I'm the same in that my family don't know so this is my secret so this site has been an absolute godsend :wink:

If your having problems sleeping your GP can prescibe something short term and I've found a walk in the evening/nice soak in the bath before bed helps things along, (it does get easier) I did think about writing stuff down but diary writing about the day is not really my thing - maybe being on here is the equivelent?!

Thanks guys that's really helpful. I will of course keep you all fully updated of what responses I get! Just been reading through lots of other threads and it just seems so hit and miss when you try and arrange payment plans. Some find it no hassle, and then others with the same company have a right battle on their hands! I am hoping for all of us that the publicity surrounding these loans lately is making them a bit more reasonable!Oh well, fingers crossed for this. Watch this space :)

From personal experience

Payday UK - Great - freezes account and confirms repayment plans in writing

Wonga - Can't really comment

Payday Express - Not so good - for your own protection make sure all dealings with these are in writing and watch the figures

 

All three's bank details are on this site or can be easily obtained :wink:

 

I don't know if it's all to do with the person you get..., the amount owed..., past history..., if they have met the week/months targets does this determine their attitude..., ooohhh certainly something I'm becoming interested in, I was lucky I've tried to stay away from long term plans which is where I think the crux lies?

What is most frightening to me is ho many of these companies there are, and how many people are sucked in...

 

And how many of us feel ashamed and keep it to ourselves... Reality is we are good people just trying to keep afloat, we shouldn't feel ashamed, better than resorting to crime !!

Some really good advice listed above. Wonga hopefully will be fine, found them fair and reasonable when explaining the situation. No dealings with Payday UK. Please take care with Payday Express, ensure everything is in writing. I agreed with a "Senior Manager" a repayment scheme, (stupidly over the phone), after 2 payments they started chasing the full amount. Still to be resolved some 4 months after. Ensure all in writing, keep records of all your attempts to contact them and if needs be, raise a complaint to OFT and FOS if they don't play fair.

Ok so here is how everything has gone so far!Payday express responded just saying they will take the interest. I emailed back, no response, and they took the whole amount this month! :(No responses from PDUK or wonga.PDUK ended up taking the interest payment.This left me with not enough to cover even wongas interest payment. However, after the loan with wonga defaulted I called them today and they were really really good! I paid a £50 token payment today, and have arranged a 4 month repayment plan with them at £204.12 a month. The interest is frozen and they are confirming this in writing to me. It will be a struggle but I just want to get out of this mess, I can then work on the final one. Literally have £50 to last me the rest of this month, but I hear tesco do noodles for about 6p so at least I can eat and still afford my train fare to work!I was so impressed about how easy a payment plan was to arrange once I called wonga- i was shaking like a leaf when I phoned. If others are worried like me, just give it a try and see what they say! Maybe I was lucky but it took no negotiation on my part at all really...he originally suggested 3 months but that would have been pushing it too much; when I suggested 4 months, he instantly agreed. I imagine I could have pushed for longer, but I just want to do this as quickly as possible.But thanks so much everyone for your great advice! You don't know how much it has helped me through :)

Get onto the OFT and complain complain complain rather than ost on here - they are NOT allowed to take the whole lot when you have come to an arrangement

Best foods are value baked beans, rice (these 2 go ok together) and pasta mixed with making use of any tinned foods you may have (canned tomatoes, veggie stuff with a stock cube can go someway)

 

Change your bank account and move funds as per post 3

Sorry if I wasn't clearer but if they say they will try for payment they really do

 

FUNDS NOW PAID comes of balances - really fight you do not want to be in any roll over situation

If you have anything in writing so far you must use it to complain where needed - which is why phoning isn't a good thing unless you can record calls

 

Well done on Wonga (get that confirmed tho) and Payday Express - I take it your clear at least now their roll over trick would have cost more if any consolation..
