Hi.

 

i have a default on my credit file from may of 2001 of a bill of £2000 to which was owed on a barclay card, I could not afford to pay at the time and the debt was sold to cabot financial, They sent me the usual letters and i more or less never replied to them and they eventually gave up,

After 5yrs they sold the debt to thames credit who is now the owner of the debt, They contacted me by phone and as i was in a better finacial position i aggreed to repay at £30pcm, and to date have paid 9 instalments Now the default on my file runs out and will be removed from my file next may and was wondering if i should send the letter requesting the supply of the original aggreement that i had with barclays now or should i just wait until the 6rs is up and then send it.

 

Hope this all makes sence and hope someone can advise me better.

Why do you want to request the agreement?

 

It sounds like you understand you owe them the money, and you don't dispute the debt, so why do you need to see a copy of it?

It sounds like you understand you owe them the money, and you don't dispute the debt, so why do you need to see a copy of it?

 

The reason is that it has been passed on by so many dca that the chances are they do not have the original document and therefore not be able to produce within the 30 calender days, I am not trying to pull a fast one , I am simply just using the law to my advantage as it is my right to see the original papers and if they cant produce would benefit me financialy, Then again if they can produce the original copy of the agreement then nothing lost.

If so, then I really don't understand why you want the orginal agreement.

When i defaulted on the credit card the bill was £1,200 now its £2000 with the dca charges,

If i ask them to produce the original aggreement and they dont within the 30 days by law, Am i right in saying that they cannot enforce the debt and so can kiss the debt goodbye.

Well ive been reading posts on this site for about 2 days now and the number of people who have done what im sudgesting is in the hundreds, Just wondering why i have no support in this matter from the moderator, Am i breaking guidelines in this forum for sudgesting running from this debt

Claim back the charges by all means.

 

If you are planning on dodging a legitimate debt then don't expect any help from this forum as it is not something we wish to be associated with.

 

You should only request a copy of the signed agreement if the debt is in dispute, or you do not recall taking out a loan. If they send you a copy of the agreement with your signature on this would obviously refresh your memory.

 

It is not a way to rip companies off by getting them to write off legitimate debts.
