Help needed - joint credit card which was originally with citicards

Hi, quick question is there a time limit on cca request?

sent my request to 1st credit on 1st feb and recd a response saying the document you have req has been retained by our client opus

and they would advise them of my request and sent to me as soon as possible,

letter dated 02/02 recd 11/02,

 

also waiting on sar from citi sent 27th january not 40days yet.

 

we dont think opus will have the cca as it was originally with citicards.

They are supposed to provide the CCA on request within 12 working days + 2. But they very rarely do. A few years ago, it used to be an "offence" not to provide within the time, but the tinkering of the CCA1974 in 2006 saw the "offence" dropped.

 

Not that the OFT ever did anything about those creditors who did fail to comply.. but it was a useful inclusion when you wrote to them saying .. "You have now committed and offence" lol

hi,

just checked a free credit report and 1st credit finance is now showing on my file with default date january,

can they do this when i have requested cca?

 

would they have not had to have cca to update crf and there is nothing showing for original citi or opus

would not have thought that they could show as owning the debt if they hadnt bought the debt

or been assigned with the cca ?

 

any advise please

there is no requirement for a cca

they own the debt.

 

their name is listed as the owner .

that happens because the debt has been sold on a phishing list

then when its brought, all ref of the OC is changed as it now has a new owner

 

they 'inherit' all rights etc etc and get their name put against any previous actions

they cannot additional defaults.

is the cca request now irrelevant?

do i now need to make an arrangement with them?

i cant afford what they are asking and they have refused my offer.

so they can basically buy debt without the cca and take legal action?

i need to know what i do now if you can advise me please?

What about that SAR request - is the requirement to provide information within 40 calenda days when SAR has been submitted still valid? If they fail to do that, is that an offence, and does it render the alleged debt uninforceable (or, at least, would it be good enough to take them to small claims?)

 

Apologies if this has been answered elsewhere; I do try to search the forums but sometimes I am afraid I can't find the latest updates.

They have to provide all they hold on you with regard to your personal data within 40 calendar days,

it doesn't have a bearing on any legal claim they may have made (as you can potentially go for disclosure on a claim by them)

but you can still take them to court if they fail to supply the information within 40 days (however in the case of a SAR, if they fail to provide anything in 40 days (or it is incomplete) then you issue a letter bfore action giving them a further 7 days to comply, enclosing a copy of the original request)

ist credit have updated my cra file and a default showing from january and still not recd cca req from 1st credit or sar from citi,

 

heres what i asked,

we checked call credit and nothing showing,

just checked with ac new company called noddle and was updated by first credit ?

so upset by this hence not know what to do now.

 

can you post up the noodle report on this debt please

status history

balance history

payment history

 

use this method:

scan the required letters/agreements/sheets

as a picture[jpg] file

remove all pers info inc barcodes etc using paint program

but leave all figures and dates.

 

goto one of the many free online pdf converter websites

it would be better to upload a multipage pdf

than many single ones

or if you have PDF as an installed printer drive use that

or use word and save as pdf

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

NB:you can set where it goes in the post by hitting insert inline.

then hit reply button
