A bit of advice needed please.

 

I personally made a PPI claim to Halifax Bank. I received an offer of just over £4000 at the beginning of december. I was advised I would have to wait 30 days for payment to be processed.

 

Over this period of 30 days I have rang their helpline a few times, just to get a status update. Each time I have asked if I will 100% definately be receiving a cheque for the amount offered.

 

The reason for this is that the balance outstanding on the credit card is considerably more than the amount offered. The balance of this debt is being paid through Payplan, the debt management company. These payment are up to date as per the agreement with Halifax. Payplan have not bought the debt, they are dealing with Halifax's debt collection agents. Its a scottish company I cannot remember the name except it has 3 surnames.

 

I have brought this to the attention of their advisors, and each time was told because I instigated the claim the money will be paid to me. In the letter of offer, it also states that " the balance will be credited back to the credit card which is still live and subsequently (if not already received) a cheque for the amount will be forwarded at the earliest opportunity"

 

The 30 day period expired last week, and no cheque has been received. I have rang everyday this week to see whats going on. They say the amount has been paid back onto the credit card, however a cheque has not been issued as yet. I have claimed financial hardship and they say they have e-mailed the payment department to get the cheque sent asap.

 

Now my concern is even though I have been told on a number of occasions that I will definately receive the payment, 2 seperate departments may have their wires crossed. I am desperate for this money but am really worried they will take it off the debt I have with them.

 

Can they do this even though I have it in writing and have been told the payment will come to me?

 

If so, what steps should I take?

I think you will find that they can offset against a live credit card account and if that clears the balance and there is some left over then the difference is paid by cheque.

 

You say that the balance on the account exceeded the refund due so I would guess the whole amount has gone to the account.

 

Can you not check the amount which has gone to the account and compare it to the offer amount in the letter?

Total owed is £10k. Amount i am expecting is £4100. I have been told on a number of ocxasions that as i had claimed the money would come to me. After lengthy chats about this with their helpline i have budgeted and paid a number of small debts off, which i was told was ok to do. The thing is now, i havent any money left to pay rent and bills this month. The payment was supposed to be with me friday so i am obviously very concerned if they dont forward the cheque. Surely i cant be advised this is what to expect only for them to keep the money when that scenario has never been suggested!

Has anything actually been paid pack to the account? If so how much?

Sorry have not made that bit clear. Halifax always credit the amount offered back onto the credit card then take it straight back off when they issue the cheque. That is what is quoted in the letter of offer as well as what i have been told more than once. It is standard practise apparently

I haven't heard that one before...I'll make a note of that.

 

So they put it to the credit card account to reduce the outstanding balance. Then they issue a cheque which increases the outstanding balance?

 

If that is the case I think the only thing you can do is keep pestering them and keep reiterating your hardship but usually the bank's estimate of when payments are made are not realistic sadly.

hi stu

i've never heard of any credit card reclaim going to a debtor unless it puts the card in credit.

 

never seen this on any halifax card before to my knowledge.

 

unless you can pull them up upon HOW

your PCM was attributed to each months debt and in what order

 

there was talk at one time that the FOS

considered each month on a CC PPI as a separate agreement

and ppi only ran for that month

till it was charged until the next.

so you could get it back...

but then the question of legit off-set comes into play.

 

sorry but i think you are stuffed

and jumped a bit quick

by being given wrong info

 

p'haps the rep got loans mixed up with CC's

 

as with loans its OBV you paid off the PPI portion each month

 

with rolling credit. its a diff matter.

Can you post up the letter of offer (MINUS ALL PERSONAL INFORMATION)

 

Use this method by dx100uk

 

scan the required letters/agreements/sheets

as a picture[jpg] file

remove all pers info inc barcodes etc using paint program

but leave all figures and dates.

 

goto one of the many free online pdf converter websites

it would be better to upload a multipage pdf

than many single ones

or if you have PDF as an installed printer drive use that

or use word and save as pdf

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

NB:you can set where it goes in the post by hitting insert inline.

Hi, thanks for all the input. I have no access to a scanner so it is difficult to post the letter of offer to here.

I will just reiterate this part of the letter:-

 

"the amount offered will be credited back onto the credit card, and subsequently ( if not already received) a cheque for that amount will be sent under seperate cover at the earliest possibility"

 

There is no mention in any of the correspondence of Halifax keeping the money to pay off some of the outstanding balance. It is not just an individual advisor that has told me i will definately receive the cheque, there are at least 5 different advisors telling me the same thing when i have explained the situation too them. They are obviously aware its a credit card as they say each time thats where it gets credited to for accountability purposes.

 

Obviously i am extremely concerned about this situation, especially after being advised more than once i would 100% definately receive a cheque!

Just a quick one on this.

 

I spoke yet again to Halifax today. Again I have been assured that payment will be made by cheque to me as that is what it states in the letter of offer. If it was going to be used to pay off arrears then the letter would have stated that. Good news, but I won't hold my breath till the cheque drops through the letterbox.

 

One infuriating thing. The timeline for payment being processed has to be within 30 days of the offer. This date expired last friday. No payment by cheque has been made so the managers at the helpline have had to "escalate"the claim, so payment can be sent asap. What is never mentioned in any correspondence is the fact that this process takes another 28 days, as laid down by FSA guidelines.

 

There's nobody I can ring and complain to, in the meantime I just have to sit and wait it out. Just wonder if this is the normal way of doing things as a "kick in the teeth" for them that dare make the claim. I also wonder what will happen after 28 days.. is there another period of time to wait while they go through another process?

I too am in the same situation as yourself stu997. I received my offer letter for Halifax loan ppi dated 29th december on 3rd january stating I will receive a cheque. I rang Halifax to find out when I will receive the cheque and they told me it can take 28 days. I am also in arrears on the account but nowhere on the letter does it say it will be applied to my loan account. Has anyone else been in a similar situation and if so what was the outcome.

What is really annoying is they didnt post the cheque out within the 30 days stipulated by the fsa.. So now it could be another 28 days to sort it.. As in guidelines laid down by fsa.

I wonder what the next time period will be if they dont sort it by then!

Am happy to know that others are in the same position asme and have been told the same. Thats a relief!!

Hi All..

 

I received a cheque today from halifax for £4113, as final settlement for my PPI claim. The card as I said is in a debt management plan with Payplan with an amount of £10k still owing. Some of this will go towards this debt of course.

 

So I hope everyone can take this as a positive outcome if you are in a similar situation.

 

And for those who give up their time to offer the advice you do, I hope this will update your knowledge on such matters, and you are able to advise all them that come here accordingly.
