      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

my parents seem pleased with them. infact everyone who banks with them who i know who ive mentioned this site to is happy with them!!! the less posts about a bank the better i think on this site... the admins here should tote up the number of cases for each bank each year and award something to the worst and best.

my ex, myself and my daughter have both had RBS accounts and been stung with excess charges. We have since moved elsewhere for this reason. It does seem that there aren't many posts about them on here though.

Definately NOT!

 

My wife and I have been customers of the RBOS for nearly 25 years. Just before Christmas 2005 I requested a small additional overdraft for a month to cover an anticipated shortfall in my monthly salary. It was refused and they then hit us with £ 271 worth of charges in seven working days.

 

Since July 2003 to the current date RBOS have hit us with charges for unpaid direct debits etc. totalling £ 3763. A letter sent to the Head Office just under two weeks ago hasn't even been acknowledged yet!

looking really good, its whats needed because this forum just has the same questions and answers over and over. i think once enough cases have gone under the bridge the BAG should recommend the most refund friendly bank (im sure there is one out there)

I have been with the Royal BAnk of Scotland for over 6 years i have a good relationship with some of the staff in my branch but this does not stop them from hitting me with charges as this became a problem i requested if there was an problems for them to contact me they did on several occassions where i was able to cover before the charges went through and got them cancelled but this has stopped and having checked my account today i have been hit with over £145 of bank charges. Knowing that i have paid alot in charges over the last 6 years i thought this has to end somewhere and i proceeded to write the letter which i got from the library but now i'm unsure of to post it or not as to the head office is in Edinburgh can anyone help me on this and advise what i should do?

Knowing that i have paid alot in charges over the last 6 years i thought this has to end somewhere and i proceeded to write the letter which i got from the library but now i'm unsure of to post it or not as to the head office is in Edinburgh can anyone help me on this and advise what i should do?

I opened an account with RBOS when I was a very young (for a free money box I think!) and I haven't used this account at all since I was about 15, (switching to HBOS with whom I've had no problems) but have never gotten around to closing it as I'm away from home at university and just use my other student account. So it was sitting there with 80pence in it, getting about a penny interest a year, and then last month I received a statement saying that I have gone over my overdraft limit and am now being charged a 'Maintenance Charge' of £28.00 a month. This is without me using my account for seven years!

 

Then I discover that the RBS have upgraded my account without my permission to a 'Royalties' one with a subscription of £6.00, something I never signed up for. Since my account did not have sufficient funds to pay for this subscription they are levying me with these monthly charges. I've been to my bank to complain but they're refusing to give me a refund and are insisting that I pay the penalties.

 

I've just written a letter to the head office, and I really hope it gets resolved. I'd appreciate any feedback on whether you guys think this is a legitimate claim on my part. Thanks!

We work very hard trying to follow people's stories and to support and advise when we can. Hijackers make things very difficult and take alot of time.

I can't understand why it isn't obvious that you should start your own thread especially when the issue has already come up above.

 

DON'T HIJACK THREADS. BEGIN A NEW ONE FOR YOUR STORY :evil:

 

I think that you should contribute to our book fund to make up for it.

I lost my job 2 months ago and started getting charges,i went into the bank to ask them to return them but no luck . Asked for a phone number for customer relations which they reluctantly gave me. The first few times they returned them(this was before i found this and other sites)but after 2 or 3 they refused,I then asked to speak to the manager of the call centre,(0800 0155035 maria chinino well thats how it sounds)since then i've had over £500 in charges returned to my account with no problems,so the moral is to keep stating that their charges are unlawful and would like them returned or your willing to take legal action if they refuse(be nice though)DON'T let them draw you into a discussion just be repetative and they give in.
