We took Halfords to SCC regarding a faulty sat nav purchased 18months ago which they refuse to budge on offering repair/replacement.

 

Halfords PLC issued an acknowledgment of service on 13/12/2011.

 

They still haven't responded as of today which is over the 28days stipulated. I was just wondering, is it OK to request judgement or do I have to wait 28 working days?

 

This has been really dragging on & just want to get it sorted - hence the question.

 

Any advice appreciated.

What was the timeline. You advise they acknowledged service on 13/12/2011 - when were they due to submit their defence?

 

Timeline is

 

Issue date + 5 for for service + 14 to acknowledge service + 14 to submit defence

 

If they acknowledged service then chances are it was their intention to defend. Have you checked with the court to see if a defence has been submitted and perhaps been caught up in the Christmas break at the court?

 

If it were a creditor who had issued the claim, they would have had their request for Default Judgment in the day after you had missed the deadline.. so.. !!

 

The timing is for 28 calendar days - not working days.

Claim was issued on 05/12/11 and deemed to be served on 10/12/11

 

Not checked with the court yet was waiting to hear from them - I'm assuming that they can be called?

Yes, you can telephone the court - you should have the number on your copy of the claim form.

Hi,

 

Just thought I would let you know that I received a cheque through the post yesterday from Halfords. After approx 6months of this dragging on they have finally seen the error of their ways (and their abysmal customer service policy).

 

I would advise anyone that finds themselves in the same situation as myself to stick to their guns and be as stubborn as a mule, mentioning SOGA at every opportunity as it's the only way you will get anywhere with these big companies that think they are above the law. I would also advise to do everything in writing and keep every receipt, letter and proof of purchase as it will help strengthen your case.

 

I would also like to thank the staff at Currys Head Office who were very helpful in promptly providing a 3rd party opinion on the issue for me. Maybe Halfords could learn a thing or two from them?
