Hi, this is my first post.

 

I have a 4 old style student loans (pre-98) which I was served a Default Notice in 2003 which covers all 4 (I still have the original notice). However on recently checking my credit report Link Financial have noted a default on my record with a date of 11/07/2009. Should this date not record the date the original default was registered? if so, how do I go about getting this changed?

Hi, You will need to write to Link with

the evidence that the default date is wrong,

and send a copy of the lettere to the CRAs

that are showing the entry, the CRA cannot

unilaterally change the entry.

All you need to do is state that you

dispute the entry and the default date,

and send a copy of the evidence you

have, copy to the CRA.

I'm confused now!! the SLC has not issued a default

notice in the past, but now link has?

In post 1 you say a default was issued in 2003?

If that is the case that default entry would have been

removed in 2009, you cannot be defaulted twice for the

same debt.

Hi,is there not some instances where student

loans do not become SB, seem to recall reading

some thing along these lines a while back, it's

about 100 years since I was a student so the memory's

not so good??

Sorry a default notice was issued (I have the original paper copy) however was never put on my credit file...looked at an old experian and equifax report from 2005 and not recorded. Because of this can link put it on my record with a 2009 date?

No I don't belive they can, as you did not rectify the default back then that is the default date.

Make a formal complaint to Link addressed to their compliance manager, enclose a copy of the

original default document, it matters not imo that the SLC did not enter the default on the CRA

files, the original stands.

Thank for your help. Link have confirmed that they will remove the default from my file. However, I had also sent them the statute barred letter which I incorrectly stated 6 years (Scotland is 5 years). My last payment to the account was November 2006. They have stated it is not statute barred. If I reply pointing out that under Scottish Law it is only 5 will they have to stop chasing?

If you are permanently resident in Scotland then

they are stuffed the debt is not only statute barred

but is totally extinguished.

Sorry to come back for advice again but the default which was removed by Link in January has appeared again on my credit record. Despite confirmation from the compliance manager that it would be removed. What further action can I take to avoid this happening again?

Ok have you purchased an update on your files recently?

If not you maybe viewing an historic entry.

Check your ''Alerts'' i should show there as action

taken.

The credit report was just purchased today an is up-to-date. It also shows that Default markers on the account for the months from January 2012 to June 2012. The company have stated (i have the letter at home) that the default would be removed. What action can be taken next?

Dear Sir or Madam,

 

I refer to your letter dated xx xx xxxx regarding the erroneous

default entries placed on my credit file by your company in this

letter it was confirmed to me that these entries would be removed.

 

Having checked my credit file held by xxxxxx I am shocked to find

that the entry still shows from January 2012 to June 2012 after

being assured that this matter would be dealt with I consider that

your company should not only remove the entries from ALL credit

reference agency files immediately but should compensate me for

the trouble and incovenience caused by this.

 

Having taken advice on the matter I believe that a sum of £500.00

pounds is appropriate.

 

Please confirm that the offending entries have been removed within 7

working days.

Just a quick update on my case and advice sought on the next stage. I wrote a formal complaint to Link on 23 July, which was acknowledged on 24 July stating it was being investigated and a reply would be issued by 21 August (they also included details of the complaint procedure). On 21 August they wrote to me advising they are still investigating and they hope to get a response to me by 18 September. How long can they delay this?

Technically a formal complaint give the 8 weeks to reply failing in this you can then report to the Ombudsman Service.
