My sister has submitted a full SAR to Mint and albeit the response received was a little late, they appear to have been very selective in what they have provided. Their letter advises her that they were unable to obtain a copy of the original application form, copy statements enclosed cover the last 6 years, albeit, there are many missing, but they fob this off with 'we are unable to obtain them from their system'!

 

They imply that nothing else is available.

 

Would the template for 'failed SAR' be worth sending them or just report it to ICO?

 

I should at this stage say that the account was paid off in full so there is no DCA invovled. Would that have any impact on their response?

 

There is heavy PPI and several unfair charges to claim.

 

My sister is extremely poorly, which is why I am trying to get her through these claims.

 

I do have experience with other claims but I am not familiar with MINT/RBS and how they're choosing to respond to their account holders.

 

Appreciate any guidance.

they'll have obv sussed its a reclaim

 

they might well be ecconomical with the truth trying to circumvent a large reclaim

 

fire off the none compliance letter stating that having reviewed information given by the ico, and the FOS, you find it very suspect that the info stops

EXACTLY at 6yrs and that what info has been sent already is incomplete.

 

i would also make noises about requiring a signed cerificate of destruction concerning the data outside of 6yrs as being ACTUALLY destroyed

as you need that in respect of a potential court case

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Wow! thank you dx. Wasn't expecting a response that quickly at all.

 

It does seem to have a nsaty taste about it but I always try to see the good in people, silly me. It is a bank after all!

If you find that they continue to fail to provide the statements that are more than 6 years and you want to put in a claim for the PPI.. then whilst it is a little bit of hard work.. you can "guestimate" those premiums that are "missing".

 

Strangely enough you will find that Mint will suddenly be able to find information on one of their other databases in order to obtain a more accurate figure :)

I had thought about that CB but as my sister cannot remember how long she has had the card (medication affects her memory) I wouldn't know where to start, but MINT don't know that so it's an idea. What a job though to guestimate something like that?

 

I have 'tweaked' a CAG template to reflect dx comments earlier which we will post on Tuesday giving them 14 days to respond. Will have to see what mood they're in.
