Our 6 year old son was awarded HRC & LRM last year due to his Aspergers & Sensory Processing Disorder. This claim took about 19 weeks to be awarded. We had to renew his claim in October & were awarded LRC only for him. This decision took only 2 days. We asked for his claim to be reconsidered as nothing had gotten better for him, in fact he's now been diagnosed with Dyspraxia, Hypermobility, & is attending Orthotics due to him being flat footed; they've had moulded insoles made to try to correct this.

We sent off the OT report, a list of specialists he see's, a Dyspraxia symptoms sheet, sensory modulation sheets which I received on a course I attended on his behalf, communications strategy sheets from another course on his behalf, a set of 4 excersise sheets that we have to make him do every day, a walking information sheet which describes how he walks & how he is affected by his environment while he's walking & of course the Claim Form.

After hearing nothing for a good few weeks I rang them up was told that his file hadn't been called for yet but that is was being logged & we'd get a letter to confirm but they were very busy & it might take a few weeks.. Obviously we didn't hear back so I rang up again, have called 9 times now & am getting a bit fed up now.

I was told on 28/11/11 that they'd requested a school report on the 16th of November but hadn't had it back yet so I asked for their fax number & said I'd chase school up & get it faxed over to them. Rang up again on the 5th Dec as school had sent the fax on the 2nd Dec. Also faxed another piece of evidence through to them myself that day. Was told that all faxes go into the normal post pile once they've been taken from the machine & could take 4 days to be logged onto a file, could I ring back in a few days?

Rang back on the 7th Dec, was told that there were only 2 DM's who dealt with childrens claims but 1 was off sick that day so our son's claim would not even be looked at for a few days. Yes they'd received the school report but no, not my fax dated 5th Dec. I explained to the lady that the fax I'd sent had details about case law in & no decision should be made until my fax had been read. Was told that she'd make a note on the account to say this but not to ring up before Friday the 9th as it'd give them time to find my fax & read the file again.

Rang up again on the 8th & was told that they must've read my fax as a decision had been made & a letter was being sent out. Wouldn't put me through to the Disputes Dept who I'd had no trouble being put through to before but I must wait for my letter before ringing up again if I needed to. Letter arrived 14 Dec dated 8th Dec, have been awarded MRC & LRM backdated to October. Rang back up trying to get through to Disputes, was told that once a decision has been made the file goes away again & has to be recalled if I want to know what info they actually looked at. Explained I wanted the file recalled as there was no mention of my fax in the award notice & they said they looked at a medical report which they requested. They never actually requested one, they asked for a School report. Was told that if I hadn't heard anything in a week to call back again but it'd be very unlikely I'd hear anything now before Christmas.

To say I'm a little bit annoyed is a huge understatement! How dare they treat us like this, we have enough stress & worry in our everyday life without being made to jump through all the hoops they're throwing our way. Our son's needs haven't gotten easier since his original award so why are we being treated like this? Any advice on what to do now would be much appreciated. Thanks.

i felt sorry for the you going through like this.

I am disable too (i have crembral pasly) i know that dla is trying to discrimated people who are geniune and caliming benfits,

They dont know u and your son thats why thei have mean tested on him. just your son doctor, Hospital, his aunties and uncles, etc who know him.

your son is a geniune dla

I find this hard to believe. I mean, I am sure there are many people who claim DLA for their children. Therefore, DLA would need to have much more than 2 DMs for childrens claims.
