Hello fellow caggers, i'm hoping you can help my mother in law out. she has paid Aims Reclaim £250 up front to sort out her PPI claim against Barclaycard. That was 2 months ago and now they have sent her a questionnaire to be completed in PENCIL and signed in ink. She is 75 years old and very trusting and paid this money out after repeated phone calls from this company. She only told us the other day as she was short of money and had no food in the house. I know she should of done a SAR to Barclaycard and paid £10. Is there any chance she can get the £250 back from Aims or is it long gone.

I expect that it is gone.

 

Are you sure that this is all that she agreed to? She may have signed up to giving a % of the win and she may have agreed to allow them to complete the claim procedure on her behalf.

 

Have you seen any written documents? Did she sign anything?

 

Anyway, you'll be better off taking it over for her and doing it yourself

If she paid with a credit card (or visa debit in certain circumstances) she can make a claim to the card company.

 

I know someone who ignored my advice and went to a claims company that subsequently went bust, but they got their money back through their credit card provider.

The link in post 3 takes you to a useful thread.

 

As well as asking the bank to refund (which they may be unwilling to do), there's nothing to stop you asking Aims to refund on the basis that they appear to have broken MOJ Guidance by taking a fee before providing the customer with enough info to make an informed decision.

Aims will charge 25% of whatever they get back plus VAT although not sure how that works as they are registered in Gibraltar. They are not allowed to take any fees upfront for PPI reclaim and you should complain to the MOJ. However Aims cleverly get around this by saying the upfront fee is for a membership of various services and not just for PPI reclaim. Still worth complaining to the MOJ especially if the rep who spoke to you never mentioned anything about the members club for other services and only spoke about getting the PPI claim sorted.

I was contacted by Aims in January 2013 and they which they took £150 up front from my credit card, I instructed the rep to contact me before taking the final £150 which was ignored and the money was just taken out which brought the total to £300. One good thing this was a credit card transaction which may give me some consumer protection. After realizing that there was no ppi to reclaim asked for my refund back, have been told that this will be paid December 14th, 2013. I have left 4 messages on their phone with no reply and have emailed the rep who I had previous contact, have just sent and email to the info email address. Will be waiting with baited breath. Will not let this lie, have kept all previous emails and correspondence. Has anyone else had problems, look forward to hearing from.

You say you asked for your money back. Was the request made to Aims or your credit card provider.

 

Have you made any written complaint to either Aims or your CC provider about this.

 

The info about repaying you by 14th Dec'r - was this by phone, letter or email and was it from Aims or the CC provider.
