Hi, ive got a following problem.

 

I bought a car on hire purchase in 2008,

everything was going smooth until i lost my job at the beginning of 2011.

Since then I have not been able to pay £173 per month for it.

 

They have sent me a notice of default in august and terminated the agreement in september.

The total ammount under agreement was £11747 and the balance left before it went to court was £5589 so I havent paid half of it off yet.

I did not attend the court.

 

Two weeks ago they came with warrant to collect the car.

I was sure Id lost it.

 

Last week it unexpectedly turned out that I am going to be able to afford the car.

I rung their solicitors who deal with it now and they are saying that if i wanted the car back then id need to pay them £5965.

 

Im thinking does the early settlement not apply here?

There is no agreement anymore and its easy to calculate that if the total charge for credit was £2747 and I have nearly paid half of the agreement off

would I not just pay half of the charge for credit around £1400?

 

Is there anything that can be done to suspend or delay their actions of selling the car on auction?

Can I do anything in court or am I on their solicitors mercy?

 

They require the full balance paid off by the end of year and I can only afford half of it by then and the rest in late january.

The creditor refused my offer and told their solicitors to send the car to auction if i havent paid by the end of 2012.

 

What can I do to get the car back?
