      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Remember you do not have to send the IE to them if you do not wish to (as others on here will tell you only a judge can demand to see one) thats is up to you ....if you do then don`t let them see any wage slips or bank statements ... probs a letter on here for that as well !

 

Make sure you are not short falling yourself when doing the form and I think that someone on here will be able to give you the amounts that most DMP`s use as a guide line depending wether you are single or filling the form in as a couple as to living expense etc.

 

Keep strong ....remember the IE is a personal document !

Whilst I've always followed advice from here... I think I'm gonna cave in a little and send them the income and expenditure form. No more, no less!

 

They can ask for bank statements, they can tear my I and e to shreds and tell me my rent amount is too much and that I should rent a shed for a month just to pay them back. They can whistle for anything else!

 

For me, this is my last chance with them. I feel like I'm back in the driving seat now. Maybe they're hoping I won't cooperate with them so they can take me to court? Or maybe they've realised that I am willing to clear the balance.

 

At last I think I'm making progress. But am not holding my breath. I will offer what I can afford. If they dont accept, then I tried my hardest. More ammunition for me to add to my complaint to the fos and oft.

I don't know if my situation will help you see some light at the end of the tunnel but i am going through financial difficulty at the moment and have a £440 (plus £110) interest with payday express, have had it deferring over a few months and i phoned them before Christmas to advise them of this, as i am sick of paying interest and nothing else. I was passed from pillar to post and had my account on hold for 2 weeks. They took £45 late payment fees from my account today and I spoke to a few people then a manager phoned me back quite a few hours later. He told me my account was now £660 as more interest had been added. He credited the £110 and also put the £45 back in my bank account and agreed a payment plan with me for £10.00 per week with no extra interest.

Keep at them...they will give in! I have received my credit agreement via email

Glad to hear that you have got somewhere with them.

 

I returned my income and expenditure details to them today. The amount I have left to live on after my living expenses is actually minus. So I don't know what they will make of those details. I fear that they will send it back with suggestions on how I can cut down on expenses etc lol.

 

I was reluctant to go against some good advice here and provide them with these personal details. I just want to continue showing them that I do want to pay what I owe and that I will cooperate with them and provide details. If only they accepted my DMP they'd have probably been given these details anyway.

 

I await a reply from my email.

 

I can't see them agreeing to my offer, I'm sure they're going to try and increase it.

 

It's nice to be able to hear my ringtone again!! Phone was permanently on silent for nearly a month!!

 

Still not sure if it was my official complaint email that started the cooperation off or if it is common practice for them to act like idiots for 3 weeks before getting involved and trying to work things out.

Honestly with all the ones I did this with I never once heard them say ..you shouldn't be paying this, that.. there was no comment. It's living costs at the of the day, don't be afraid to admit it and you'll soon be through this hurdle worrying about the next one in life

 

Do insist you get confirmation of plan/freeze of interest/reduction of charges/what the account balance actually is etc - it could prove important further down the line.

 

I reckon it will be alright - you've both shown willing x

It's probably me just thinking negative thoughts lol. I shouldn't really speculate until I get the reply. They have just wound me up for too long now with their rejection and ignorance.

 

The email I received was reassuring and I could quote a lot from it if I don't get the outcome I hope for... Basically states that as soon as they receive my I and e that they'll agree to a payment plan.

 

I'll edit out the personal data and copy it here tomorrow. I can imagine though if anybody at PDE reads these forums they'll know by now who I am anyway because of amounts quoted!! Lol

 

If this thread has had some influence on their decisions then it can't be a bad thing anyway. I've told No lies about the company I've been truthful from the start.

 

I'll be asleep most of the day following my night shift but hopefully will update tomorrow with good news!

I know where your coming from - why do we think they don't have a facebook page!!!!! I particularly like the lengthy disclaimer on the bottom of the 2 line email they cared to send me last week at 17:17!which more of less made reference to if our staff agree with u it's more then their jobsworth - that is cruel but I guess how these operations are run and I was never able to be rude because I know at the end of the day they are just doing a job Hoping it's good news my friend : ) I'll have everything possibly crossed for you!x

Well.

 

No reply from them today unfortunately. Maybe they're sat there scratching their heads at my income and expenditure details.

 

Will keep you updated with any response I get.

 

Phone calls, text messages and ring back calls have completely stopped now though :)

Well I got home to a letter from them today :-(

only took them a week, nearly had the waterworks because I was that wound up but decided enough is enough !

 

I'm sorry I can't believe I've ever thought anything of this company - it's management is a disgrace

I can't believe I used the services of this company for 2 ½ years

Think we've both been loyal customers of theirs for about the same time. In that time, I only ever paid the loan back once in full, the rest of the time it was the monthly extension charge. A frightening amount of money to be honest.

 

When reading here before defaulting, I thought that my conduct over the years would be taken into account and that they may look at my situation with a bit of sympathy. I suffered a mini stroke which had a knock on effect with the amount of hours I could do at work. Also my expenses have increased dramatically - I can no longer walk to work (still a bit unsteady on my feet), buses are useless, a long walk to bus stop and a long walk from bus stop. Unfortunately it's taxis to and from work nowadays.

 

I'm past trying to avoid paying my debts! I done that when I was 18 and naive (and stupid lol). Really just want to get this sorted.

 

This wasn't my only payday loan. Also had to take loans with poundstillpayday and wagedayadvance. Ptp were absolutely fantastic to be fair! Agreed to my dmp straightaway - this was a much more recent loan and they haven't made a penny in extension fees/rollover fees from me. I salute them for helping me out when I needed it.

 

Wagedayadvance, although it appeared that they were ignoring me. I've had an email from them recently claiming that there has been a break down in communication between my DMP and them. They have stated that when they receive the letter of authorisation that they will have no problems in dealing with my DMP.

 

Slowly getting there. I'm wondering whether they change their attitude a bit when they receive payments from DMPs or self helpers?

 

I've started answering unknown numbers again. I've got the confidence now to give PDE a bit of an ear bashing before telling them "in writing only" - although, as stated in my previous posts, they've stopped ringing and texting.

 

The only phonecalls I get now are offering me other loans... And I've been put off this for life!! This is what happens when you dish your number out to payday lenders! Am slowly unsubscribing from all the emails. Never EVER again lol.

I don't say this lightly but have you looked anymore into the debt relief order? I think it was mentioned on a posting on this thread? I know it is a personal decision but when you've done all you can In my ivory tower !! I wasn't used to any roll over c&@p by PDE in 25 loans (now perhaps they did think I was a risk lol!) not until the last loan was I treated in this way I can only imagine what might have happened if I had NOT been a defaulter and that is my gripe, so I didn't realise or appreciate the roll on is the actual killer! so that is how I survied quite a while I guessYou've probably seen this before because you seem like the educate yourself type person like me, but I do kinda get the impression the PDL's hate fee charging DMP's for some reason and that is why your maybe getting the grief (which is quite rich of the PDL's companies if you get me!) I believe over the yrs my phone number has been handed over to the likes of ***** and ***** Crooks by the very companies that don't make it easy when it comes to dealing via them!!!I'm glad the others are going someway to assist - I'm just the same even if that gets me called a 'fan' or a lover (I have a lot to love for!) then so be it but then it does seem to make the process even more barbaric with the ones who have to put a thousand Obstacles in the way hey! Anyway I hope you will have good mail today ! x

Still not had a reply from our friends at PDE. Maybe no news is good news. I'm in a better place now than I was a month ago. I feel more confident to deal with this all now.

 

These forums have helped me MASSIVELY.

 

I think we all believe that we are the only ones that have been Stupid enough to make these mistakes. This site reassures you somewhat. New threads appearing here daily from people also in the same boat. People posting here like I did 6 weeks ago. Out of their minds with worry, wondering how they're going to cope..

 

It's by far turned out to be less of a hurdle than I thought it would be. Yes, of course payday express wanted me to pay them £80-£100 per month forever without ever paying back the original loan. If someone was daft enough to deposit money into my account every month - I doubt I'd turn it down...lol

 

Here's hoping that PDE will email me back tomorrow wanting to be my friends again lol.

 

Again, will keep you updated. Really hope I post tomorrow with the reply I'm waiting for from PDE. If I don't get a response, I might send them 3 emails a day asking for their response - just like they did to me lol.

This wasn't the email I've been hoping for... It's the sane email that they've been sending me since I defaulted and asked to go onto a payment plan - only they had stopped sending it and as in previous posts, I was getting a more personal response for a while.

 

Does this look like they've read my income and expenditure form and decided to do naff all about it and start the campaign of pointless email and telephone harassment again?

 

I feel like setting up a standing order for £1 a month to these guys and NOT cooperating with them anymore.

Still nothing heard.

 

Have emailed the 2 named contacts and the customerservice email address asking for an update. Requested also an update on the investigation (telephone harassment) although I'm quiet happy that I'm no longer receiving text messages and automated calls.

 

The email I was sent originally requesting my I and e details (minus personal details and senders information) is below. I read this as once they've received my details then they'll "play ball" and agree to a payment plan??

I did again reiterate in my reply the desire to have them added to my DMP but also, as they have so far refused, offered them the opportunity receive money outside my plan (I will ask my DMP to change the amount I pay and simply give PDE the money directly - a hassle I know, but have always offered maximum compliance with them in order to come to an arrangement... But they still not having any of it.

 

Anybody still following this boring & repetitive thread lol, I'll keep you updated x

I wonder if it would be worth reminding them that a DMP has to treat all creditors the same way - pro rata the disposable income. The only priorities would be essential spending mortgage/ct/utilities/etc. No way would they consider an aggressive PDL company a priority.

 

Remind them if it went to court eg if they were to start litigation, the court would not favour them over your other creditors and would almost certainly see that you had made every attempt to include them in the DMP

I cant see why not.. something along the lines of.. as they are not willing to be part of the DMP, the DMP manager is unable to make allowances for those debts outside of its management and therefore you would only be able to spare £1.00 from your allocated housekeeping budget. Of course if they are prepared to be incorporated into the DMP then the manager will reassess the pro rata payments and the amount set aside for XYZ would be.. £X amount.. :)

This is what I once heard "holding account at our discrection for 7 days...." while when they wouldn't talk - those 7 days cost me £10 per day which is why I'm now so furious :-x

 

If nothing else make sure you don't get seen of, because I've got a funny feeling this is how they make their charges on people who end up with plans

 

 

Hello by the way Bombaymix :-) Sorry just got a bit taken over then! you can treat me as barking I won't mind but I'd hate to see anyone end up in angish because this company enjoy pulling the wool over the eyes

I've pretty much decided my next move. Should PDE and WDA refuse to accept these reasonable repayment offers or keep ignoring/delaying me... They will both be offered £1 per month. After all - my I and E shows that I'm already in negative balance each month.

 

They've had plenty of opportunity, PDE say they can't accept the DMP as the loan was taken out after the DMP but since emailed me with a promise that if I sent them my I and E information and a offer of repayment that they'd accept.

 

Jeez!! Are all these payday loan companies the same?? With the exception of poundstillpayday who agreed to the plan straightaway and who've been receiving payments since.

 

Monday morning. I'll be penning the 2 letters to both companies and sending them recorded delivery. Will contact my DM company and tell them to divide payday express and wagedayadvance's allocated payments between the other creditors and I'll sort them both out their token £1 per month. Obviously I don't want to be in debt to these companies forever, so hopefully they'll quickly send them both off to DCA's who I'll be able to deal with more successfully. It really does pain me to say that I'd rather deal with the likes of Mucky Hall or Lowells over the payday loan lenders!!!

Hello,I was on here a few weeks ago ,I too have payday loans that I am attempting to sort out this month.I have changed my bank account thanks to advice found on here and am currently e mailing all companies with a proposed payment plan.I can't seem to find an e mail address for Mr lender can anyone help? Lol @ the headset lady. She sure is busy!!

 

She looks approachable though to be fair! I might give PDE a call and ask to speak to the headset lady. She sits opposite the abrupt automated man and just down from the work experience boy he sits sending text messages all day lol.

 

Tomorrow is still the day! If nothing is sorted tomorrow. They're getting the snottiest letter ever offering them £1 per month for the next 27 years...

 

A few personal issues today that have left me even more in the mood to fight these reprobates..
