Hi,

I Recently recieved the following whilst parking in a free Carpark.

There are to my knowledge no signs at either entrance to the carpark.

Notice of intent to Prosecute.

 

The above vehicle was found to be in contravention of the above order/s with regard to the provisions covered by them for this carpark. the council is excercising its powers under section 35(A) of the road traffic regulation act 1984 and the said orders and may prosecute the driver for the offence / s stated.

on the reverse of the ticket is a list of offences from 1 to 10

 

on reverse there is a paragraph at bottom...

 

if you wish to offer mitigation for the offence identified in the front of this notice, write within 14 days to:

Now, on the front of the ticket Offence 1 is just ticked. it does not state which offence occured.

Would this be grounds for defence, as the ticket does not state clearly which of the 10 contravention codes took place.

 

This is not the first one i've seen filled in in this manner.

I know what the offence is, Vehicle parked outside of a lined Bay. What i'm trying to ascertain, is, has the ticket been filled in correctly. what if the numbered offence was, say number 7. there aren't 7 tick boxes on the sheet. Surely the correct entry in the box that he/she has ticked should be the Number 1. not a tick.

Can you scan both sides, suitably clensed of indentifying personal stuff?

It should also ask you if you were the driver and if not, the requirement to name the driver under s.110 of the RTRA

Without seeing the whole of the ticket its impossible to give a definitive answer. Besides, I suspect that the ticket contains far more print than you have detailed above. Is the ticket described as a "Penalty Charge Notice" or an "Excess Charge Notice"?
