bought new tv online from company ive used before

there is a fault in that the lcd is damaged from inside

requested a straight swap for one that was of merchantable quality they refused but said they would collect it foc inspect it and decide what path to follow

i refused asked for a refund

they have stated they will collect foc but if they find no fault wont refund

what are my rights and what course of action should i take

Have a read of number 11 in my signature. Communicate by letters so you've got a record what they've said.

they have now agreed to a free collection on tuesday but still insist that if they deem that tv is not faulty they will not refund and further thery will charge me to return the tv have read the dsr regs so in my opinion they are totally out of order

Take some pics of the damage, take down the serial number, any other relevant numbers from the set. Lodge a complaint with Consumer Direct, they'll give you a complaint number. Lets see what they say when they've inspected it.

all sorted after a strongly worded letter to their head office

they found the item faulty and informed me that they would refund the cost

yes youve guessed it they tried to charge me for the postage but the distance selling regs were pointed out to them and yes they asdmitted theyd made a mistake, but how many other mistakes are being made
