Why did you send back an acknowledgement to Cobbetts? are we meant to, it didn't say anything in my defence about acknowledging? or does it matter?

 

Yes it would be interesting to see what happens with our progress, will have to keep it touch!!

Don't worry Alf, some people are asked to acknowledge receipt of the defence, I was, but I just popped a brief letter on the fax to them. It's not that important!!

In Cobbetts letter it asked me to acknowlege receipt of their defence, so I sent a letter doing just that with a further copy of the claim details. That way they haven't got an argument that I didn't reply.

Morning All

 

hey Bigmama, i found the covering letter today from Cobbetts asking for an acknowledgment (oops), oh well i have done my AQ ready to send back to the court, complete with chq for £100, full 2 pages of POC, schedule of charges, and a copy of a letter that i am sending to Cobbetts, that replies to their defence,(they reckon they can't understand why i am claiming any money back):rolleyes: MAD.

 

Also I have sent a copy of everything to Cobbetts, i dont know if this normal practise, i just thought i would bombard them with it all (haha).

are you sending the AQ back now or waiting a while because some people have said to wait a bit in case they send an offer through before it's due and then you save £100. I wasn't quite sure what to do so I haven't sent my AQ yet.

The £100 will be reclaimable anyway, so its just individuals preference whether to return AQ early or leave it until the deadline. I personally returned mine early in the hope that it would give Cobbetts a push, dosn't seemed to have worked yet though!!

Anything's possible, there doesn't seem to be any trend to what Cobbetts are doing at the moment, people are receiving different sorts of offers at different stages of their claims.

It is advised, that way Cobbetts will be aware that you have returned your copy. I actually faxed them a copy and phoned a few mins after to make sure it had been received.

It will really depend on what deadlines you both have on your AQ's, Nat West seem to be holding right out until the last minute before returning theirs!!

I am really pleased that both of you have heard something , mine does not have to be in till 10/12 so probably won't wont hear anything for a while.

 

I did get an upped (by £200 :eek: )offer for 2nd account, this account has not gone to mcol, just waiting for 1st to get out of the way. I was thinking what i might do, is send back a reply saying thanks but no thanks, and also state that acc no 1 is actually going through the court stages as we speak, and suggest that this 2nd account will be going the same way within 14 days, if i don't get full payment, what do you reckon?, it couldn't do any harm could it. I now that i should have already put the 2nd acc through to mcol, but quite frankly, what with the 1st still at AQ stage, i feel my brain might explode if i was to carry on with the 2nd before the 1st was sorted.

 

Anyways, if there is any news through the post, i will put it on here, on my thread, for all to see. :p

i wouldn't mind i've sen lots of of things i would like for Xmas :p , but i do think they are playing hardball at the minute & i wouldn't be surprised to get a court date, mores the pity...........never mind i can live in hope.........gosh those shoes were gorg thougth lol :D

Can someone help please, i have had a letter from Cobblers today for half the ampount i am claiming. They have res'd from me POC & Copy of AQ etc, They say i can only claim for last yrs& my charges include some prior to that, but is they looked at their records they would see that i started my claim well before 18/10/06 anyways, so that bye the bye.

 

 

Is thier a letter i can send back to them refusing thier offer and stating that i want the full amount?

Here's an example:

 

Thank you for your letter dated XX November 2006.

 

I first contacted your client regarding their unlawful charges on xx/xx/xx and therefore disagree with your contention that some of these charges fall outside the scope of the Limitations Act 1980. However I am happy to let the court decide on this matter.

 

I respectfully decline your offer of settlement and request, once again, that you return to me all charges imposed on this account, interest and court fees, which together with the daily rate of £0.XX now total £xxxx as of XXth November 2006

 

I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder.

 

I will be willing to withdraw my claim upon receipt of unconditional full settlement of my claim.

 

I am also not prepared to agree to any confidentially clauses you try to impose, unless of course your client wishes to make an offer of due consideration in addition to the amount of £xxxxx, in order to be afforded this privilege by myself.
