Hi all,

Found this site quite by accident after reading an article on AOL re: claiming back your bank charges. Just like to say what a fantastic job you are all doing for us, the common people. THANKS!!!

Anyway, gathered all relevant info and sent off my preliminary letter to the Halifax on 19th September. I received...surprise...a standard letter saying someone will be in touch with me within four weeks to discuss my complaint. Do I still go ahead and issue the LBA in 14 days if I have not heard from them, and if i do hear from them offering say, a small fraction of what i am claiming as a goodwill gesture, do i give them another 14 days to cough up the full amount and should I still go ahead and claim the full amount through the court as per my original schedule. Or should i accept the offer, would a court still award me the full amount in light of the offer.

Hope that makes sense. Would be grateful for any feedback.

Have you read the FAQ's? everything you need to know is there.

 

Do not stick to their timescales stick to yours....so yes once the 14 days given in the prelim letter passes, then issue the LBA providing another 14 days. If you receive a offer which is less than you're claiming, the write back saying you accept this as an interim offer, however you are still pursuing for the rest and that the clock is ticking.

 

Once the 14 days of the LBA runs out, if you haven't received your money in full then start your court claim.

Oh my God!!! PANIC...PANIC...

Quick update, I sent my prelim letter requesting refund of £444 in charges and just before 14 days was up I received a letter from the Halifax offering as a "goodwill gesture" £268 in full and final settlement and the usual threatening to close my account if i do not manage it properly. I wrote back declining offer but willing to accept it as part payment etc etc. I have now received a letter back from the Halifax saying that as I have not accepted their offer of £268 they will not be refunding me any of the charges i have incurred since opening my account (although I have only claimed for the last six years and held an account with them for 18 years). They say if i am not happy I can go to the Financial Ombudsman Service with my complaint. The 14 days since my second letter is up on 23rd October.

Please can someone tell me what to do now, do I still go ahead with my court claim? Are they likely to defend it and are they likely to win. Are the banks getting tough now because of the number of people demanding refunds.

I am feeling slightly bullied by the bank and a little confused,i have read other peoples threads and i cant find one where the bank has withdrawn their offer and refused to pay anything.

Any advice and help would be greatly appreciated.

send LBA. wait 14 days issue MCOL.

 

they paid in full 3 days after MCOL plus 8% interest.

 

remember you are in control not them!

Go ahead with your claim, they are bluffing. All of the banks do this and look who is winning.

 

Stick to your timetable. Have your parachute account opened and let them do their darndest.
