    • Thanks I just had a quick look.  Will study over the w/e My friend does have kids. But it's a really dysfunctional family.  They don't talk.   Many years ago he sold 2 property assets and gave them a lot of money (enough to buy homes w/o loans) .  They've done nothing for him in the last 2 decades. And he altered his will so his new partner gets everything; the kids nothing (more). The 1st form I glanced at - to be deputy - asks for family details.   If I give his kids details I suspect the authorities may say they should get the deputy job instead?  Then  they will steal the money and give nothing to his partner. I can get a copy of the medical assessment  - and get it translated.  If need be.   This has all happened very quickly.  He got sick. And that must have kick-started dementia.   He was fine to hold a detailed conversation 6months ago; now he cant
    • Hi I think the only way around this as he lacks capacity is someone is going to have to apply to be a deputies via the Courts as he has assets here in the UK and a UK Bank Account which will take time and there will possible be Court Fees to make the application. Also if the Lack of Capacity (Dementia) was diagnosed abroad the person applying for deputies will need that diagnosis and it will need to be translated legally for the UK Courts so possibly cost for this as well. Also for reference although you were assisting them before the lack of capacity and had authority to act on there behalf that no longer stands due to there diagnosis of Dementia therefore Lack of Capacity so you no longer have any authority legally to act on there behalf unless the below is actioned or someone has Power of Attorney for that individual (which was setup before the Lack of Capacity) Have a wee look at these links: https://www.gov.uk/become-deputy https://www.lawsociety.org.uk/topics/private-client/mental-capacity-international-aspects#:~:text=You might need to make,act within the foreign jurisdiction https://www.gov.uk/government/organisations/office-of-the-public-guardian I have got to ask with the Dementia diagnoses are you 100% sure the diagnosis states they Lack Capacity as not everyone that gets a Dementia diagnoses may lack capacity initially. Now the Office of the Public Guardian link above you could also consider giving them a call just to give them a brief on this situation and get there advice on what documents etc are needed for deputies to be appointed as the person with Lack of Capacity is abroad.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I received this this morning? Not sure of the legalities of it but I think it is morally wrong!

 

I have visions of somebody really hard pushed to sort out Christmas falling for this and then being in the clutches of Lowells.

I'm sure I have an old SB with these guys, I'll just whip out my credit card and settle so I can get my free gifts....Oh wait, borrowing what I don't have in order to pay for what I can't afford, that's what went wrong in the first place :(

 

I bet the only free gift you'd get off them is a nice new fleece ;)

Just found this - a conversation with TLC Marketing who run the promotion for lowlifes. TLC seem to be totally intune with lowlifes....

After a day of phone calls, I finally was able to get TLC Marketing (or at least some guy in India) on the telephone to discuss the Dockers JCPenneys Free Round-Trip fiasco (see last post).

Neil: I’m calling about the Dockers Free Round Trip Ticket… I still haven’t heard back from you.

TLC Marketing: Yes, did you fill out the form?

Neil: I filled out the form a long time ago. I received a phone call saying everything was OK.

TLC Marketing: Then, you will be receiving a call from the booking agent.

Neil: When will I get this call?

TLC Marketing: You will get be receiving a call from the booking agent.

Neil: When? I’m supposed to have a flight on July 16th.

TLC Marketing: The booking agent will…

Neil: Can I give you my name and you can look it up in the computer? Maybe you can tell me when I will get this call.

TLC Marketing: I do not have access to individual records. You will be receiving a call from the booking agent…

Neil: When? In the brochure, it clearly states that I will receive a call two week after you receive the form.

TLC Marketing: You will be receiving…

Neil: When?! My flight is next week already…

TLC Marketing: Those with completed forms will be receiving a call from the booking agent starting on July 22nd.

Neil: On July 22nd?

TLC Marketing: Starting on July 22nd, you can negotiate your booking.

Neil: What?! My flight is supposed to be on July 16th.

TLC Marketing: You can negotiate it with the booking agent.

Neil: How am I going to negotiate my July 16th flight with the booking agent on July 22nd?

TLC Marketing: That’s something you can negotiate with the booking agent.

Neil: Is there a supervisor around?

TLC Marketing: All the supervisors are busy.

Neil: I’ll wait.

TLC Marketing: The supervisors are unable to take any calls today. You will need to wait to speak with the booking agent.

Neil: And what am I supposed to do now? I asked for a flight on July 16th.

TLC Marketing: You can negotiate it with the booking agent.

Neil: No. It doesn’t work that way. I can talk to the booking agent on July 22nd, but I cannot negotiate my July 16th flight with the booking agent on July 22nd? Do you understand what I’m talking about. The flight is on July 16th. The call is on July 22nd.

TLC Marketing: I only know that the booking agent will negotiate…

Neil: So, I WON’T be getting my flight for July 16th?

TLC Marketing: I cannot say that. You can negotiate…

Neil: Why can’t you say that?

TLC Marketing: That is something to negotiate…

Neil: Negotiate what? There is no POSSIBILITY that I will get a flight for July 16th on July 22th. Do you have a calendar in front of you?

TLC Marketing: Yes, I do.

Neil: So, you understand that I will NOT get my flight on July 16th.

TLC Marketing: I am not saying that. This is something you can negotiate…

Neil: Is this being recorded?

TLC Marketing: Yes.

Neil: What is your name?

TLC Marketing: Menuel.

Neil: Manuel?

Neil: Forget the booking agent. Just me and you. Do YOU see it as possibility that I might still get my flight for July 16 on July 22?

TLC Marketing: I am not a booking agent That is who you will negotiate…

Neil: Can I speak to a booking agent then?

TLC Marketing: The booking agent will call you on July 22nd.

Neil: So, let me say this one more time, so the recording can hear this. You, Menuel, a hired and paid employee of TLC Marketing, and a representative of the company, is telling me that no one can tell me whether or not I will be getting my July 16th flight to San Francisco until July 22nd, when I will receive a phone call from a booking agent where I can then negotiate, and still possibly get my flight to San Francisco on July 16, even though it happened to leave six days earlier?

I really, really, really, would not want to encourage anyone to do anything silly like I just did and register. Surprisingly I found that this format LOABC123 did for the Lowell reference number. I am also not sure how the number for Anne Summers in Poole has ended up in their system, but there you go.

I got this when I registered: "Thank you for entering your details. Your payment will shortly be validated then you will receive an e-mail within 48 hours with your PIN code." It will be interesting to see if I get a pin code. Somehow I don't think I will though.

Anyone notice that the 21st of December is on a Wednesday? It then takes "up to 48 hours" to get your Pin number ( Midnight Friday 23rd). Theyve excluded weekends as Xmas falls on the Sat and Sun.

Hands up all those who think they are going to get something off Lowells for Xmas!:lol:
