      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Guys, I am hoping that somebody can help me with some advice on my situation. I had arrears of £280 with Payday Express, I agreed a repayment plan with a representative via email (still have these emails). The balance was cleared in May 2011 after paying £20 per month. However on checking my credit file it appears that they have only just in the last few weeks (25/09/2011) reported a default to the CRA's. The default appears to be incorrect also as it states I have still got £100 to pay, I have received a letter from Payday Express stating the balance is clear. Also the default states the account started 03/11/2008 and the default date is 03/12/2008?? Does this mean that they have defaulted me after 30 days? I honestly never received any default notice letter from them, is there anything i can do to prove they sent it? Any communication from them after the repayment plan was a automated email reminding me of the payment date. I did not miss one payment.I have rang the company who have said there is nothing I can do because I didnt pay the loan back within 90 days so therefore they are in their right to added a default notice. I think this is soo unfair, some people wouldnt have paid it back and I did and Im now having to suffer for 6years for such a low amount...Is there anything that can be done to have the default removed? Thank you

If any consolation I'm fairly sure PDE mark everybodys credit file even ones who don't pay! Try not to take it personally.They are very slow in reporting anything they actually put info on a week back about my previous 'settled' loans taken at the start of this year! As someone else has said you can tackle with the CRA's but the company didn't have to offer us a repayment plan and could have persued court action my understanding - this is the problem when you have a long term plan I imagine and have borrowed from a company that do mark your report - risk that comes with taking any finance.

Nooooo Quackquack they do not !Also hun you will prob need to phone your bank to cancel their direct debit instruction to I hear even if you have online banking .We're both settled up with Quick Quid end of this month aren't we!Still glass of proper wine at the ready me thinks : )

You may notice from other threads I am subscribed to that I am in the same situation as you. I had a loan with Payday Express last year that I couldn't pay in full so negotiated a payment plan with them. I have paid this every month on time and I got a default about a fortnight ago registered on my account with a default date of Jun 2010. There is unfortunatly not much you can do as technically you have defaulted on the account and Payday Express will say it is correct. They are poor at updating their balances etc and still show my default as owing £75 more than I actually do so I would chase them to update it at the very least. I thankfully am in a 'very slightly' better position in that I still owe on my account - I am currently playing the 'joker card' of you will get £1 a month for the next 15 or so years unless you remove the default as a full and final settlement. If they want to take me to court then I am also fine with that as I am only paying back charges they added now anyway so I would really like them to stand up in court and defend their charges. We will see what happens next.......

Let us know what happens, I'm interested since agreeing to my plan (which is a small piddly amount in all honestly) they been so quiet not a peap it's scary considering! mind you thats not stopped them entering on my report that I took a loan out on 25/09/11 when I was already in a repayment plan....!!! their getting ready to default me next year I bet! you heard it here first lol!

Can I ask how long you've been in a plan with them? I would love to be rid of them but think they will be one of the ones I have to deal with the longest now along with Payday UK :sad:

I have been in the payment plan with them since Jun 10. I have made every payment on time never a minute late and despite them sending me the letter when I arranged the payment plan stating that as long as payments were made no further interest would be added and no default action would happen they went ahead and defaulted me 3 weeks (ish) ago dated back to Jun 10. I don't know if this in itself gives me a right to query it with the credit agencies as I was under the impression they had to register them within a certain timescale although technically I guess the date of the default is correct. I am just annoyed as they stated in their letters I wouldn't be defaulted if I maintained payments but now they won't budge on removing it - well they can go £$%^$"£^%&$&" if they think I will be making payments as arranged now.

On a plus note and believe me I really don't like this company I have to say in their favour that with me they were really good sorting out the payment plan in this first place and I never got any hassles off them - just a shame this good point was spoilt with the default as I don't often find things good to say about them.

Ah bless you thank you for that, interesting to know, yeah I would agree they actually were by far one of my easiest in the end considering their a lender 'they don't allow plans along the lines of ...unless your deceased... etc, sure that was one of their lines along with the silent power of the credit reporting! I guess I don't really wanna rock the boat at the mo though and am enjoying the peace really I should work on getting them paid up next - the 2 month council tax break falls in nicely with when we're due to review

Hmmm, my plan confirmation letter makes no reference whatsoever to not credit marking just the freeze of interest as long as payments are maintained etc and this was written August time of this year so perhaps you can take yours further on this basis ? I can see now why you'd be furious with whats in your letter

UPDATE - taken a while but here is the update. Just received an e-mail from Payday Express confirming that once I make full and final settlement of the account at the end of February the default will be removed in total from my credit file. I have it in black and white from payday Express and a copy has just been sent to my solicitor for info just in case.It just shows it can be done - this is great for me as my credit file will be clean of defaults and all other payments are on time and for once I don't have to worry about having a negative credit file. A good result for once for me and i hope the same happens to all others out there in the same sitiation. I just hope they stick to their word but as I have it in writing it will help should the worst happen.

Great !!! woo hoo! : ) I like, glad you didn't have to stick with the pound a month...knowing what I know now about these cretins so well done on getting it in writing. Glad their improving their letters but still aiming for the ones they wrote me to go before a judge.

Been reading your post with much hope in my heart and just wanted to ask how you managed to get payday express to accept a repayment plan. I too have fallen into the payday loan cycle and enough is enough. Mine are with payday express, payday uk and lending stream. People like you and a smile cost nothing have great posts, and i would just like to see light at the end of my own miserable tunnel x

It now seems that the removal of a default when the account is paid is the norm, I had that from another company today, NOT a PDL company but a major company - wonder what the LAW (and I mean LAW and not Guidelines) states - I am sure it is an abuse of their position to do this.

 

If you have it in writing and they have broken their word

Hamster - you will get a plan if you COMPLAIN COMPLAIN COMPLAIN and make sure any figures quoted tallys with what you think you should be paying ; ) In the first instance I believe the Consumer Finance Association helped (that could be a wild guess tho) but odd how they only started talking after I got in touch with the CFA on asking for a plan I heard all the usual c--p at first of data protection, account held (so it could build charges), no plan unless deceased/unemployed/redundancy so it is just getting through this. Thanks for your reply. I have spent hours reading as many posts as i can on payday loan companies and peoples experience, and i must say i'm still a wee bit confused. I emailed payday express and payday uk before, to ask if they would consider a repayment plan and both came back with a hugely long email that basically said no. They are happy for us all to keep paying the interest every month and they must know that we are struggling when we can't repay the original loan the following month, and when you tally up that you borrowed £320.00 and have paid back £480.00 in interest alone, it is just complete madness! I will email again and ask for a repayment plan and i will do as you say, and complain, complain, complain. Everyone regrets they're payday loan mess and vows to never to touch them again. Its the worst thing i ever done and i'm ashamed and so very angry with myself for falling into this trap and at times i have felt suicidal with being so low over my mess x

Hi hun, these PDL companies will never be worth taking your life over it can get better, I have been there (6 months on I am still largely an insomniac but something has taken over and I won't rest now till these PDL's are curbed or change their ways) and from all the threads and posts on here know that you are not alone x :-)

 

Personal thoughts and some may not agree but

 

Have you thought of trying the media?

 

I would formally write to them and send recorded delivery - heading letter Formal Complaint so there can be no confusion - tell them what your proposing and if you don't get anywhere that you will take further and will look into formal solutions as with no other options, because this is what their forcing you into (I know this sentence sounds hard or shockable to some but it is the truth and that can go with any debt I'm not saying oh it really doesn't matter it is only a PDL...)

 

I remember considering a DRO or Administration Order when both companies you mentioned were very difficult - 1 in particular wrote 3 pages of why they couldn't assist so I wrote 3 pages back...as determined as they were

 

Remember in the end going before a judge can sometimes be the best outcome

thank you, its just so good to be able to talk to someone who's been through this and came out the other side. I've emailed both companies again, and lets wait and see what happens! But i've promised myself that i will complain to everyone who will listen if they don't try and help me with my current situation. I want to repay them, but at an affordable amount where i can get through the month and not be sitting in floods of tears or having sleepless nights cause there's just no money. Another quick question, how long did it take for the payment plans to be set up? :|

If my history helps anyone then it will not be in vain, had my good days and bad.. but you will soon be through my friend, believe that got to have faith, once the PDL's drop of you will be in a different place - hope this doesn't get taken the wrong way but make a couple of changes now to the lifestyle (eg. change to basic value foods, shop around for the best deal, buy smellies from pound shops, try planning ahead, get artistic if you've got birthdays coming up, cancel subscriptions, make sure your claiming all the benefits your entitled to even if working) if you can it will save you maybe from taking one of these wreched loans ever again

 

Whilst I made contact a couple of weeks ahead of default in answer to time frame for plans I found

Payday UK - 5 Weeks

Wouldn't talk until the day of default and when they couldn't access funds because I had closed off old bank account (they did try)

 

Payday Express - 3 weeks

7 days technically after 'default'

 

Heck I could probably have been done for harrasment lol! I was on their case pretty much daily!

Sorry to hear about your predicament and the way you've been treated by these people. if you can, (and admittedly at times it seems impossible in that you're taking on a company single-handed), don't take it personally. In my experience, payday loans, and Payday Express in particular will build up the pressure until you cave in and agree to unfair, unreasonable and, well, fibs.

 

Lots and lots of people have been in similar positions like yourself, and although it seems tough now, you will come out the other side.

 

Take copies of everything, don't phone them or answer calls, make complaints to OFT, Trading Standards, FOS, your local MP (or Stella Creasey who is banging the drum against this out of control industry), the words above of "COMPLAIN COMPLAIN COMPLAIN" will enable you to take control of the situation and put the ball back in their court.

sorry for taking so long to reply, but thanks to you both for your words of wisdom. my mum had another stroke last night, and payday loans was the last thing on my mind. My belt has been tightened, and luxuries are now a thing of the past, but it will be worth it too hopefully be payday loan free in around 5-6 months and be back in control and never to have to resort to this again. As i said yesterday, i emailed both companies again, but so far no response. And complaining to everyone is my next step, i'm wanting to repay them, just need them to understand that a repayment plan is the only way i can do this. Thanks for listening xxxx

You're going through the mill at the mo, without a doubt and I hope your Mum gets better soon.

 

The companies that aren't responding, use these e=mails as proof (if you ever needed it), that they aren't going to take you seriously until you take control, and get the complaints in action. I realise you have other matters to deal with, however if you can sit down, take some time and get the complaints off to OFT, Trading Standards, FOS, your MP, media, anyone you can think of and put the ball back in their court.

 

Chin up, keep fighting, you'll come out the otherside.

thanks again to you both. i've been struggling for a year if truth be known. my job is problematic and im working more hours for less money. tried finding something else with no joy. i like everyone else thot a payday loan was the answer, but how wrong i was. a situation arises, you apply for a loan, you're convinced that it will be no problem paying it back and then something else happens and then it all spirals out of control. all my other bills are up to date, its only the payday loans that are the issue. all i'm doing is paying the rollover fee and i'm getting nowhere with the initial loan amount. all i have in my purse is enough money to put fuel in my car to visit my mum, but that doesn't bother me. i made this mess, i've got to sort it. going to spend tonight sending letters to everyone who will listen and take note what these companies are doing. all i'm asking is for them to be reasonable and listen to my plight. payday express and payday uk, u will get your money, but only if you help me. xxxxx

Your last line is so true - keep it and use it

Default rather then roll on or extend even if that means to worsen your credit report but as paydaypayback has proved even that can be turned around if you really want, I don't think there is anything you can do with the previous roll on fees paid BUT you can try fighting any charges that is attempt added with the default even if your told your account is froze check the figures are as you expect
