on 1st driving lesson with new instructor and car hit us

had a driving lesson on thursday the 9.11.11 with a new driving instructor got to a junction with traffic lights i had braked as was on red, but the person behind was in a corsa and drove in to the back of us, we indicated to turn left and so did he but then he took off, the driving instructor took over and took us to see if we could find him else were but no luck.

 

we pulled over and he rang the police, who said they would be out in the hour but didnt i went home and he went police station, i had complained of a sore head and neck. I have not yet been questioned by the police about this, which is a shock i was the driver at the time, the instructor has spoke to his insurance firm and said i was the driver at the time of the accident

 

i have been the doctor due to my shoulder and back and a headache that has not dissapared since given stong pain killers that knock me sick but do nothing this is horrible as i have 4 children 2 of which reguire me to lift them every so often which really hurts

 

i got told today to claim but surley this would affect my driving instructors insurance and possible mine when i pass, i also said how when the other person who hit us took off!! but keep getting told it will not affect the driving instructors insurance or mine and that i can claim as govement had a small pot for stuff like this

There are occasions when your insurance company (the driving instructor's in this case) could claim against MIB as the 3rd party, but there are rules governing how and when this can be done.

 

I currently have a claim proceeding on this basis as one of my learner cars got hit by an uninsured driver. As we had the full details of the vehicle we are hopeful the MIB will accept the claim which then won't affect my insurance policy. If you do not have the details of the 3rd party vehicle, then what you can claim through MIB is greatly limited..
