    • Did you send them a letter of rejection? You're still within 30 days and you should have done this. I emailed them with the details and advised them they need to refund the vehicle as it's within 30 days.They replied stating that they are not going to do anything. So I have had my response already. Ill address your other questions shortly.
    • We don't often advise appealing a PCN, it's true. It's too easy for people to out themselves as the driver and make things more complicated. You've been here since 2015 – and am curious to know why you didn't come here first before you started getting into formalities with them. You have a responsibility for the vehicle. However I would indicate to them that you are going to be charging him storage from the date that you first tried to return it to them and they refused. Did you send them a letter of rejection? You're still within 30 days and you should have done this. You say that you bought the car on 9 July. What they did you issue the claim? You should have implemented the pre-action protocol of giving them 14 days notice before you issued the claim. It appears that you haven't done this and this could pose a problem for you if the matter is raised in court. Why didn't you send them a letter of claim giving them 14 days? Please can you go to these questions carefully and address each one

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I would like to know for example, Argos is selling a DVR box at £249.99 and Comet at £199.99. If I had not shopped around and brought the Argos one could I have taken it back to Argos to either get a refund or the money difference?.

 

Is there a legal obligation to do that?

Although there is no legal obligation to do so, Argos have a 30 day refund policy.

I thought the above too also, but not all stores price match. Fortunately I shop around before I commit to a purchase as well as checking reviews on products.

Lots of stores have a "price match guarantee" but they also are full of exceptions. Some do not price match online prices, some it needs to be a nationwide chain that they price match. Some stores offer a "14 / 30 days returns policy", but unless the stores policy is otherwise, you cannot return the item once purchased from a store (although for online purchases companies legally have to offer a cooling off period)

If I find a place cheaper after I've purchased the item I always take it back and get a refund.

But that is at the stores discretion or the stores own policy. You have no legal right to demand a refund if something is bought in error.

 

 

As with Argos you pay for the item before you see it... do the DSR's not apply?

No, because you are there in store and you can ask to inspect the item there and then. DSRs are in place as over the phone and internet you cannot inspect the items.

When an advertisement declares or implies that the price of an article is the best available and you find something better, there is then the right to rescind because of the Misrepresentation Act 1967.

 

It is therefore an offence to present a best price guarantee i.e. "rights given to consumers in law as a distinctive feature of the trader’s offer."

 

(number 10 of Schedule 1 to The Consumer Protection from Unfair Trading Regulations 2008)

 

If they're not pretending that the price is anything so special there is no complaint to make.
