i was wondering if anyone could check this for me and let me know if theres anything they think i could add, change or delete before posting to hsbc in the morning.

I am writing further to your letter dated 1st December as a response to my complaint.

I am disappointed that there is a need to write to you again, but I am afraid the response you sent me was no where near acceptable for me to consider my complaint dealt with.

You advised me that guidelines laid down by the Office of Fair Trading allows banks to telephone customers between 8am and 9pm on any day of the week. I am not disputing the fact that you are legally allowed to contact me, I am making a complaint about being called about something which is not true. Ie: Being late on a loan payment, in fact I was told 2 months is arrears. I find this completely unacceptable.

This may be the case, but you didn't HAVE to convey the information as it was inaccurate and insulting.

The content of your reply is, to be frank, useless. You have not addressed the fact that you have called and written to me with completely false information. Only told me that you are allowed to call, that sometimes people don't like what you have to say (which I didn't as it was untrue), and told me when my next loan payment would be due.

This will be my last attempt to rectify the situation with yourselves directly before taking the matter to the Financial Ombudsman.

they have been calling and sending letters (not received any now for a week) saying i am in arears on my loan which i am NOT. this is my reply to their pointless reply.

hi all

 

just wanted to see if anyone was going through what i am right now, i have a managed loan for 2.5k, and have sent off a cca to hsbc, the loan was taken out in 2002.*i think* they have until dec 28th to comply with the request before they default.

 

anyone else doing this?

wow 18k, and i bet most of that is interest and charges!!

 

cca is something well talked about in the debt and bailiffs section of this site, its basically asking for the original copy of the agreement. if they cannot provide that within 12 working days, +2 days for postage, then thy are in default. another 30days and they have commited an offence. that means to enforce the debt they MUST go through the court and firstly explain why they commited the offence in the first place. im dying to see what comes of this with hsbc they have acted so scummy

I had an ML with HSBC but missed payments and they sent it to MCS. I'm just in the middle of claiming charges from HSBC and I'd love to pay the ML back with them!! I sent SAR and CCA but never received copies of the loan agreement for the ML, thats my project for after christmas!!

08/11/06 - Statements from Jan-2001 to Jan-2004 rec'd. Requested more but am waiting.

09/11/06 - Sending of prelim request for refund! £913.50

27/11/06 - Letter from Royal Mail, original prelim lost in post!!

06/12/06 - Another prelim sent :(

19/12/06 - Reply from Mr Langdale saying complaint received and that I'll have a proper response by 5th January 07....

Sent off prelim for £392.00 - All adds up I suppose! 06-12-06

Partial Offer received 19/12/06 - £152, offer accepted as part settlement only......

Store card account. Charges approx £200, prelim being sent off in the new year!

Hi Helznpeanut,

that's really interesting, I'm definately going to look into that! I've just worked out tonight that basically, the unlawful charges we are claiming from them is over 10 grand. That is the amount of the overdraft they gave us and then put into the ML. The other 8,000 is my OH credit card which we are still waiting on copies of.

So I'm pretty sure most if not all of the ML is unlawful charges, my blood boils just thinking of what they've got away with.

We pay £254 per month and £180 of that is interest! Absolutely shocking.

We have been paying this off for a year and hardly a penny has come off it. It's over 11 years.

Lees - same here, deadline till they default is 28th, so im witholding payments from then, and taking it as far as i need to.

 

Lisa - OMG!! i cant believe the things they make ppl think is all them 'helping'!! hope u get some success! def look into cca!

i could really do with some advice on this i really not sure what to do for the best.

 

i got my bank charges back from hsbc and asked for a cheque. i said i would accept their offer which was about £150 less then my claim, on the understanding that it was a cheque, and the most recent charge of £100 was reversed with immediate effect.

 

they mucked up and paid the money into my current account, i took out £100 of the £1255 they paid in, only to find the next day they had taken them back out of my account. this left me overdrawn, and they have still never reversed the £100 charge i mentioned in the acceptance letter.

 

i have a managed loan with hsbc, payments due out on the 19th of each month, so now the one due out today has been returned as the account is overdrawn. so im guessing tomorrow there will be another £30 charge on there, plus i will be overdrawn still.

 

i dont know what to do now, i know i need to start again with a prelim letter to recover the charges, another £25 due out on 25th dec included, but im at a loss what to do about my loan payment? im so angry with them that they have left me in this mess. any advice?:mad:

I assume they have withdrawn the money as they are going to send you the cheque you requested, that shouldn't take them too long and once you have that cleared, I would go back and ask for the charges because of their mistake. Many people are having their first few charges after or between payout returned with no trouble and it won't do any harm to try rather then go straight back to court. I had £170 reurned by A&L with a week of them paying out.

unfortunatly i have tried that route, i cannot go into the branch as i have spd and sciatica, prob now until my babys born late jan, and have been told on the phone that 'nothing can be done over the phone'.

 

my main concern at the moment is what to do about this bounced loan payment :(

So did the say what they were doing about the charges? Is the loan with the same bank or a different company? If its the same one, i'd let them whistle for it until they have paid in full.

 

If it isn't, you can only write and ask them if they can defer payment as your banks has deducted money from your account in error and you will sort it as soon as possible.

its a managed loan with the same bank, the legality of the loan is a whole other issue as its something i need to look into in much more detail.

 

when they sent a letter offering £1255 out of £1400, there was a letter to sign and send back, i sent my own letter along with the unsigned letter they sent me, saying i aknowledge and accept your offer of £1255 on the condition that the payment is by cheque only, and the most recent charge dated....... is reversed with immediate effect. then i signed it. next thing was, i had the money, but that was about 3 weeks ago and still not reveresed that charge. i guess now i could carry on with claim, adding interest on the unpaid part and adding the rest of the charges, but the loan is still a question.

 

do you think i should write to them?

Yes I do, and I would also check that you're not being charged for unpaid amounts on the loan account too. I wouldn't send them the prelim letter, i would state the facts of the mess they have made of this and the resulting charges and demand that they put it to rights immediately or you will be straight back to court. I think I would have been tempted to pay enough in to cover the loan payment with a covering letter saying the money was for the loan only and to be taken for no other reason.

to be honest i forgot totally about it until it was too late. got issues right now stemming from pregnancy and my daughter having a tummy bug, otherwise that is definatly what i should have done.

 

maybe i should consider a letter stating what they have done, and ask my mum who also banks with hsbc, to transfer the loan amount into the loan account first thing? im not 100% sure that will work though, although it has a sort code and account number, can funds still be directly transfered?

 

also something else, just to be more of a pain, lol. i was called on several occasions and sent a letter saying i was in arrears by 2 payments which was untrue, this was last month. i complained, got a complete shambles of a reply, and followed it up with another complaint which ive had no reply to yet. they are bound to shut my account, lol

Firstly yes, two accounts with the same bank can transfer instantly, ask my son, he's constantly robbing mine!!! (these are with HSBC and First Direct) I don't think a loan account is any different and by doing that she would be bypassing your current account which is all the better.

 

Your loan account should possibly have been covered by your SAR so you could also ask them why this information wasn't sent.

 

From what you've said, it doesn't sound much of a problem to lose this account, hardly the most efficient bank in the world! BTW they can not demand the loan back, they need to make arrangements for it to be paid off.

its DEFINATLY not a problem to loose this account, opened a parachutte account with my partner and we just decided to start using it right away to avoid money for xmas etc from being taken in charges which we may well get back but doesnt help at the time u need shopping lol.

 

i will get my mum to pay the money to my loan tomorrow and ill give her the cash, that means that the bank has no reason to winge, and ill start thinking how to word my letter regarding not doing as i asked when i accepted the lower amount. im so angry i cant think straight writing to them! its one thing after another with the stupid place!

ok i failed to pay the loan, my mum was going into hospital for an mri scan and to be honest i forgot about everything else. so now im behind a payment and have suffered another £25 illegal charge.

 

so..... here comes claim number 2, £150 altogether in past couple of weeks. £25 of which is due out xmas day!! thing is im not sure weather to make it claim number 2, or as threatened in my last letter to them, carry on with number 1 as they ignored my request to refund the last £100 on my account. had they done that the loan money would have come out fine.

Does anyone else have their loan agreement still from taking out a managed loan with hsbc?

 

With the help from someone on this site *im sorry i dont know his user name only full real name* i have found out that a credit agreement should tell you 'total charge for credit'. my loan agreement is 4 pages long, and not once have i seen that sentance on it, and i have checked over and over again.

 

shall be making an appointment with a solicitor for a free consultation to check things out and i'll post back, but if im right, and LUCKY lol this agreement will be rendered unenforceable;)

how many times has anyone experianced claiming before they close the account? im not worried about it as been using another bank now since i was about 2 weeks into first claim, i was only asking out of interest?:rolleyes:

To be honest there is no set rule, but you have a parachute account anyway. :D So claim away ;)
