      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Can HFO still chase for the money if they have a charge against my property?

Hi Could do with som advice

 

I had a few credit cards which i had no choice but to default on. back in 2006 and 2007

HFO own the debt and did not want to take any payment from me instead they decided to attached the debt onto my property. Not too fussed about that but they are now calling me again saying they want the money and pay up.

Can they still chase for the money if they have a charge against my property?

 

Also these debts will be 6 years old next year can they still chase me for this money and will the charge on my house stay forever?

Can you give us a lot more detail – who was the original debt with?

 

Did you get a CCJ? They can’t get a CO without one. Which company has the CCJ, and which company has the CO?

Yes i did get CCJ's Sure it was Hfo Services Ltd

 

They would not accept a payment plan that i could afford so attached a order to my property a couple of years a go

 

The original Debt was for a Credit Card Morgan Stanley. The debt was 5,500 but currently stands at 11,500 because of intrest Hfo have added since the default (September 2006)

The charge will stay after 6 years and in fact until you pay it or sell the house, they did have a charge against me , but I got the original CCJ set aside , which removed the charge, so we need more info as DB requested and then we can advise.

Cannot remember the rate but sure on the court papers it was 12% or something they added £3000 in admin fees i think and charged interest from the date of the original debt default

 

Not had any statements at all the exact amount according to my credit file is £ 11,610

 

Someone turned up at the door this morning demanding i pay the full balance and if i dont they will send in the balliffs.

 

My main question is can they do this if they have a charge aganist the property which is in negative equity.

 

Dont have any paperwork as we are going back a few years and i had forgotten about it until someone turned up this morning

 

I do have another debt with HFO for £3000 Just found a letter saying they are charging 12% so sure the Morgan Stanley one is also @12%

Er, they cannot do that. They would need an enforcement order from the court. Were you given a copy of any such document or given notice? Where did the ‘bailiff’ say he was from? Did he provide ID? This looks like one for the OFT.

 

They are also not allowed to add charges they are not entitled to. You need to dig out your paperwork.

The chap that came to the door was not a balliff just a door knocker sent on behalf of HFO. He got me to speak to them on the phone and thats when they said they will instruct balliffs if i did not pay.

They can’t instruct bailiffs without a court order. Time for the OFT to get involved. Did the door knocker identify himself?

No he just asked who i was and he was calling on behalf of HFO. I did not take his name. He did not show me any ID. I should have asked but was the last thing i was expecting this morning

 

Will dig out the original CCJ 99% its 12% interest

Are you married/co-habitating and is the debt in joint names or just yours?

If you are married/co-habitating and the debt is in just your name you could of i believe applied for a restriction on the charging order so long as the property is in joint names.

it may well be registered as a restriction, you would have to contact the land register for your area.

If it is registered as a restriction then jasper could feasibly sell the property and not pay HFO anything!

 

I agree, when I got mine removed, it turned out to be a restriction.I think this is why they,re putting the pressure on, as legally they cannot take any further action.

thank you for your replies

 

I live on my own single dad with my daughter who is 17 and in full time education. Will check if its a restriction.

 

Restriction or not can they take further action. Im not looking to sell up for years.

 

I need to check a few things why they slapped so many charges and the rate (12%) interest.

 

Like i said for got about this until this morning wasent concerned as when the day comes will sell the house just to clear the mortgage
