    • FINAL UPDATE.  I have not posted as the defence were reading the thread.  An agreement was reached on the day of the hearing.   I am unable to go into detail but for those in this position the forum has been priceless support and advice so thank you all in the site team.   for those going through this, follow the process, ignore intimidating tactics and threats and get to the Judge.  They are very supporting of those self representing.   I note her name has gone from the heading of the thread.  Was this them ?  Thanks again.  
    • I'm not sure what the "appeal" system asked but he said he definitely didn't indicate he was the driver so I'm just going to have to take his word for it. Honestly, I don't think the hirer will contact them. I think my brother will tolerate it. I did have a similar experience with another company 6-7 years ago and sought advice on here then to which you guys told me to ignore, I got the exact same DRP letters and then a "Gladstones Solicitor" letter.  After that nothing happened and it died away. Based on my experience with that I assumed the same would happen here but only asked to see if perhaps anything had changed since then.    Hopefully it doesn't get to court but if it did, I feel like we have enough evidence to sway a judge who probably hates dealing with this type of nonsense anyway. Or maybe I'm too optimistic.

    • Meter certification periods re given in The Meters (Certification) Regulations 1998, Schedule 4. From there you can check if they are correct about your specific meter .. https://www.legislation.gov.uk/uksi/1998/1566/schedule/4 If they're telling porkies then you have e clear grounds to tell them to take  hike. If they're correct or if you haven't been able to confirm then you have  few options. You could just keep fobbing them off. In general Octopus can't keep up with demand for smart meters. It took 9 months to get our. So they may not push too hard. Or ask if you can install your own choice of meter. The Electricity Act 1989 cover this in Schedule 7 (2) and (2A) https://www.legislation.gov.uk/ukpga/1989/29/schedule/7 Or fight the them and their enforcement. Or go off supply.
    • We received a copy of the completed Directions Questionnaire (N181) from the solicitors along with a draft copy of their directions. I am on a course today so can upload over the weekend if needed. By 4pm on 16th May both parties must each give standard disclosure of documents by way of list by category. By 4pm on 30th May any request for inspection or copies of docs must be made and compiled 14 days thereafter. I will provide more over the weekend.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

 

My partner and her family have always had loans with Provident, which is collected at her sisters house.

 

A few weeks ago my partner received a letter stating that she was in arrears by £120 and to pay it immediately to catch up, any problems then to talk to the collector but the main thing was to carry on paying.

 

The issue they were having was the number of different collectors that kept coming, I think it was about 4 in total that changed every week or so.

 

She has only missed 1 payment, and she spoke to a doorstep collector who agreed that if she had missed then it is usually caught up the week after - as she wants to clear it as soon as possible. But she is still 1 week behind.

 

This guy said that because of the different collectors and that their printouts didnt match up with the loan book that is left at her mums, he will arrange to get the arrears written off. Next thing she knows that his manager is at our house trying to sort it out, but in the meantime to continue to pay. He also changed the day back to the Monday even though Provident agreed that they all got collected on a Tuesday. He wanted a payment to be made on her debit or credit card, which my partner declinded.

 

Another doorstep collector turned up at our house yesterday for the money and she explained that she hadn't been out and can she come back tomorrow when she collects everyone elses. The collector said that her area manager - the on that was out last week that wanted a debit card payment - wasn't bothered about anyone elses, just her payment and that she wasn't supposed to leave until she got the money. He said that if she cannot pay then to take her debit card details and he can take the payment, she also offered to goto the bank for her to take the cash out and then she can change her pin number tomorrow. Obviously she declined both.

 

As her and the kids were ill, she arranged for her mum to pay and she would pay her back today.

 

Now when the collector turned up today for everyone elses, she explained something to my partner which she is confused about. Last thing I knew was that her loan book was taken away by this manager.

 

Has anyone else had problems with Provident and any ideas how to sort this out?

 

I am tempted to send a letter to Provident head office outlining a complaint of harassment and things not being done even though they were promised. Any idea of a letter to write?

Has anyone had any dealings with Provident? They are now saying that my partner owes nearly £700 in arrears, even though she has paid it. The statement shows that there are a lot of missed payments and also "Office" payments, which are payments made by a card. My partner has NEVER paid by card.

 

We found out today that the Area Manager that bullied her a few times 2 years ago was in fact fired around that time and has been done for £40,000 fraud along with another doorstep collector - has anyone got any info about this?

 

We have sent 2 letters, not recorded delivery, to head office asking them to investigate but to no avail. The current collector, who does seem ok, has said that a reply would be very unlikely.

 

We are at a loss as to what to do, they have offered that if she pays it off then when it gets down to £100 then they will write the £100 off. Apparently other local clients are not paying as well due to issues with their accounts.

 

We are at a loss as to what to officially do as there is obviously a serious issue with the collectors around here, but Provident Head Office aren't arsed about what goes on just that nothing is paid.

 

Obviously with the debt being so much, I am concerned with debt collectors etc.

Don't worry about debt collectors, a 3 day old new born has more teeth than those goons!

 

You must know the amount taken out?

And the amount to be paid back and at what rate?

 

Stick to this and forget any other doorstep collector.

Get onto head office, in writing, and lodge a formal complaint, then exhaust it.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

You really need to get a letter off to head office for a full investigation.

If as you say only one missed payment then the arrears should be really low and not £700,

Sounds like the collectors where actually collecting for themselves.

 

I would personally get a letter in to head office,

1: You want a full investigation and audit of your account

2: No more collectors at the door, Refuse until this is sorted out

3: Token payment of £1 per loan via standing order until the investigation is sorted

Hi George

 

It was all written in a book, but at the time they collected from the sister in law. 2 letters have been sent to Head Office with no reply, the doorstep collector has said that we would be lucky to get a reply. He also said that around the time of the payments going missing, their area manager and another collector was prosecuted for fraud of £40,000. This area manager actually bullied my partner to get payments out of her, including asking for card details. She stood her ground and never gave him them, he also threatened through a door step collector that he would be round to sort her out if she didn't pay anything. This went on whilst I was driving home from work.

 

I do not understand why, if a collector and area manager got done for £40k fraud, that they are still chasing money when we are disputing payments made at the same time as they were frauding.

 

I had a quick look but I cannot see anything online regarding the fraud, does anyone know about this?

 

I was thinking a final letter to Provident, but how can I state the fraud if I cannot find anything publicly about it?

Don't listen to a single word these doorstep collectors say, it is usually all lies anyway.

 

This so called 'fraud' isn't anything to do with you or your issue here, so ignore it.

 

Stick to your issue, have you got evidence you sent head office your complaint?

If not submit another letter of complaint and when you send it, obtain proof of posting which is free from the PO counter.
