Claiming back DCA charges

Hi Guys, this is my first time post so please be gentle with me.I have just found out that last year my daughter paid money to Fredriksons for a debt that she had run up with a mobile phone company. This appeared to include some charges which my daughter said was pretty extortionate. These had been applied obviously to get her attention quickly. Anyway, she fell for this and paid up by credit card.My question is; Is there any way that my daughter can reclaim any of these charges or has she been had? She has not kept any paperwork for this and her recollection of the matter appears to be selective. I think she's pretty embarrassed that I found out. Would a SAR be the way forward?Thanks in advanceHodgsoi

I think we need a bit more info on this.

 

Who was the mobile provider? I do hope it's Vodafone

 

Unless it is written into the terms and conditions of the original creditor, the DCA shouldn't be adding extra charges. Whether you can get them back is another matter

What level of charges are we looking at?

Hi Silverfox thanks for replying.I am a little sketchy on the details as my daughter says that she doesn't recall much of this but what from what I gather the debt was geniune but the charges were added by Fredriksons. She thinks that the contract was with Orange.I would just like to know if there was a way that I could find out what charges were levied and if I could challenge them even at this late stage.

Had Freds bought the debt or were they collecting on behalf of Orange?

 

Are you sure it was Freds that applied the extra charges?

 

What usually happens in mobile phone cases is that as well as the cancellation charges (which are the remaining monthly fees) they add an administration fee. How much this fee is depends on how long was left on the contract.

 

As for reclaiming the charges. Not absolutely sure

Thanks Silverfox. To be honest my daughter doesn't really have a clue and I don't have any paperwork. She is certain that it was Fredriksons. As she didn't keep the paperwork we can never be entirely sure that's why I wondered if a sar would highlight anything useful.

If you are thinking of doing a SAR, I think it would be better to send it to Orange rather than Freds. That way, you will get more than Freds have
