Well, I’ve just opened my post…. Nice letter from Mucky Hall (McKenzie Hall) telling me:

"We write to give you formal notice that Quick Quid has legally assigned the rights to the above debt to Mackenzie Hall Debt Purchase Ltd. This means that Mackenzie Hall Debt Purchase Ltd now legally own the debt.

 

We act for Mackenzie Hall Debt Purchase Ltd. We have been instructed to pursue you for the full payment with immediate effect.

 

TAKE NOTICE: You should accept this letter as formal notification that unless payment is received within 7 days then your account will be considered for legal action in the County Court for recovery of the full amount outstanding. Any such proceedings will include additional claims for legal costs and interest which will increase the amount that you will be required to pay.

 

THERE WILL BE NO FURTHER WARNING – PAYMENT IN FULL MUST BE RECEIVED NO LATER THAN NOON, xx OCTOBER 2011

 

In the event that judgment is obtained against you then it will be entered into a public register, the Register of Judgments, Orders and Fines. The details will then be passed to Credit Reference Agencies, who will supply them to credit grantors and others seeking information on your financial standing. This will make it difficult for you to get credit.

 

NOTE: Quick Quid have already advised the Credit Reference Agencies of your Default. This may seriously affect your ability to obtain credit in the future. Once the balance is paid in full, only then will the default be shown as ‘Default Satisfied’.

Now then, up until June 2011, I had been rolling over my QQ pay day loan from since November 2010 – paid off the loan in December 2010 and then took out a new loan and had been rolling over fees up until June 2010 when I cancelled all my direct debits, opened myself another bank account and have been burying my head in the sand ever since – well not quite, just ignoring non-priority debts which not only include my mortgage, energy bills and food but more than that, my biggest priority, MY CHILDREN the circumstances of which are quite frankly, too long winded and really painful to try and explain, but there you go and here we are. Now it seems that all and sundry are baying for my blood!

 

I’ve been reading around on a lot of payday loan threads and I am not in the same boat as many who offered repayment terms and were either ignored or worked something out. Payday loan companies where just at the very bottom of my list of people I needed to pay and I suppose I could have offered £1 token payments, but seeing how other people struggled to even get bank account details so they could pay by standing order, just put me off. As I said I had more important concerns. Then I thought, well if I go after all the “institutions” who have unlawfully taken money from me in the form of charges and ppi, if, and when I get any redress, I could then settle these non-priority ones – in the case of payday loans, one month loan + plus interest (yes sillygirl1, I have been following your advice).

 

Anyway, I have “off-loaded” my woes enough. :violin:

 

The question is how do I respond to Mucky Hall now? I know "two wrongs don't make a right" and that "you can't be wrong and strong" but I'm so freakin tired of being "played" in a sense. They have already called me at work and not on the mainline number but have left a message on my actual ddi line (how the heck they got that I don’t know as I never give that number out!!). They don't appear to have called me at home yet, but have tried on my mobile and I have blocked them. How do I even begin to try and negotiate with Mucky Hall, as they will just want to fleece me for whatever they can get or do I not even bother and let them take me to court? I haven't had any letter from QQ telling me they were assigning the debt either. In the end,I only want to be able to pay what I TRULY owe and no more - I just dont know where to start with this lot.

 

Okay, I am getting a migraine and all emotional with the stress of all of this now (the majority self inflicted I know), but still....

 

Thoughts/advice? Very welcome indeed.

Mackenzie Hall will have no chance taking you to court, they can't get the POCs right for this type of claim, you can counter claim quite simply by showing that you rolled over the loan so many times the original repayment was met plus their over inflated interest - a simple defence devoid of any legal jargon is enough to stop them.

 

By leaving out legal jargon you are also giving them no room to counter-argue and no room to start messing about asking for the case to be stayed.

 

Simply put this is a low status non priority loan and should not be given precedence over other loans, again this can be put in the defence should it come to that.

 

If Mucky Hall start ringing you tell them in writing only and report them to East Ayrshire Trading Standards.

 

QQ By the way may not have 'locus standii' to take people to court in the UK as they are American based and have been banned from several states in the USA, as well as in Canada.

Hi Sillygirl,Thanks very much for stopping by and for the advice. As mentioned to Brig, I would lke to get the CCA letter out today, but it's not looking likely at the moment as work is crazy!Interesting what you say about QQ not having 'locus standii' in the UK - does that mean they can't put defaults on your credit file or is that just a long shot in the dark?I have read before about reporting MH to EA TS. I did contemplate it when they were harrassing me over another debt (which they had no right to do as it was already being handled by another DCA) but never bothered as once they realised they were getting no joy or response from, they quickly foxtrotted oscar!I will get a letter of East Ayshire TS and also a cease and desist telephone letter to them as they have already started with the phone calls and now I am getting texts as well. Just a quickie.....

 

I noticed that the amount that MH are claiming I owe is very different to the amount I do owe to QQ i.e. original loan plus 1 month's interest. It's nearly £100 CHEAPER! What's up with that!?

Wish I could Mr. Brig, really wish I could! I would so totes love to just to get them off my back! I might be able to do it next pay day (and I mean November as got potential overtime coming) but not this month - no extra donsai for Coffee this October pay day.

 

I'm hoping tomorrow will be a "quieter" days work wise, try and get some thoughts down on paper/computer on how to respond to MH. I'm usually a tough little chiquita and I have always managed to figure things out on my own when the going got tough but I have never been in such a hole as a I am in now. I'm seeking guidance on so many issues/creditors rght now. I wouldn't mind if it was a case of "living it up" for years beforehand and its now time to "pay the piper" but it hasn't. It's always been about just surviving - me, my little angels and my family. Anyway, no time for self pity, time to take the bull by the horns, salvage what I can, pay my really owed dues. So any guidance/pointing me in the right direction either you, Sillygirl1 or any more experienced CAGGER than me who hasn't dropped by to this thread yet who can add to the mix will be SOOOOooooo APPRECIATED!

I too am dealing with MH for a QQ debt and received the same letter as you recently.

 

As I too had buried my head in the sand and not told QQ about my financial difficulties I decided, in the end, to write to MH to offer £1/month as I'm on benefits. Not had any reply fro MH as yet! I await their response with interest!

 

I too had rolled over the loan the maximum 5 times and, with QQ helping themselves to 40% of the debt after payment was due, I've mire than paid back the original loan and one months interest fees - I never knew the rolled over interest paid could be taken into account when it comes to paying things back!

Hi Coffee et alI am further down the road with the Mucky Hall/Quick Quid fiasco than you are. I am at the ''doorstep visit threat'' stage (the second time I have been threatened with this). In reply I have emailed them and told them that I am not negotiating any further, I sent them a breakdown of what I have borrowed and what I have repaid (in my case much more than the total debt plus one months interest) and told them to take me to court to get it sorted. I will let you know if this ''bluff'' works. I also included the usual recommended reply about the doorstep threat - anyone coming to my house will be reported to the police for harrassment etc (I am sure Sillygirl or another mod will point you in the right direction for the exact wording once you get to this point). If it is any help whatsoever, I was worried sick January this year but as time has moved on and absolutely nothing has happened I often forget I have this 'problem'! Don't worry please - concentrate on your kiddies and your well-being; they are most definitely not worth it.

Just be aware that a DCA may well

call your bluff, and escalate

the case to court I have seen

this tried and fail.

Mucky hall have a payday loan of mine which I'm paying back at £5 a month. Admittedly, I only owed about £200 to start with but after a couple of sternly worded but polite letters I got them to behave.

Thanks for the replies and sorry for the lateness in doing so - had a bit of a family emergency and so haven't been able to get on here until now.

 

Has there been any response to your letter chrisjones60?

 

I've got a CCA and a cease and desist telephone letter already to fire off to them tomorrow and then I will take it from there as I have other bigger fish in the frying pan to deal with that are actually at the court stage.

Thanks quackquack. I'm trying not to worry. I'm just so worn out. Work keeps me busy during daylight but come the darkside I'm so tired I can't get the brain to engage to do what I need to do with these debts. Just trying to get some kind of order of who is chasing me and who I'm chasing right back!

 

Anyway, back to reading more on here, make notes etc as I need to get my head around my next steps after AoS and do a defence for Halifax CC who are taking me to court.

 

As always appreciating the sterling people on here. When the stress takes it's toll and the tears start to flow, you guys give me hope and strength to "feel the fear" and get on with it!

Hi Coffegirlnothing at all from MH yet - as far as I can make out after visiting this and other consumer forums they try to frighten you into paying what you cannot afford to pay. Stick to your guns, you know what your priorities are. YOU AND THE KIDS!!Will let you know if and when anything happens.Take care.

Hey quack quack, yes I'm not letting this lot get to me anymore! I'm in control not them. My biggest headache to on this journey had been with Halifax. I've had brilliant advice and support on here regarding them! I've also learnt too who and who are knowledgable on certain things and all those lovely CAGGERS you have named I have been following the advice they have been giving others so I have a fair idea how to play the game with these bottom feeders!

 

But thank you too for dropping by. I appreciate your kind words and good advice. But don't worry I'll be sure to send you the invite to the show when I get round to partaying with this lot!

Dont know if this helps but ive been chased by quickquid from mucky halli just kept asking for things ignoring them and they didnt do anything. this was 2 year ago and ive still not paid it, (i will pay when other debts are sorted)they passed mine onto motormile finance who are doing the same but they are a bit more threatening and when i tried to arrange a payment plan they abused my card details and took money out without permission. luckily my bank claimed the money back. i wouldnt worry too much yet

They can pass the parcel all they want. When I have it I will pay it and only what I owe and nothing more. And by no means do I have any intention of giving any of these bottom feeders my card or bank details - they give me theirs!

Hi - I had a loan with QQ too, which I will pay off once other priority debts are sorted. I am happy to pay back original loan plus 1 months interest, but NOT all the ludicrous charges and additional interest they have added on. Had ARC credit on the phone several weeks ago (Trevor Munn Solicitors threatening court action before that). I told them to take me to court and I'd go from there. The guy was a bit taken aback and didn't really know how to respond. I've not heard a peep since but would certainly relish a court case.

Halifax - £2281, successfully refunded all charges after LBA letter & telephone call.

Have been offered the difference between the £20 and £12 charges from Capital One -- am sending LBA for remainder.

GE Money - Received settlement of £441, being total charges requested. No interest though.

CCA'd Bank of Scotland / Blair Oliver Scott to produce CCA Agreements on two Credit Cards - well in default, although still chasing payment!!!

EOS Solutions "ceased action on account" on behalf of a friend.

 

All in all, quite busy at the moment and enjoying every minute of it
