      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

This month's payments match my total salary since my life spiralled out of control because of my partners insistence on taking out payday loans to cover the mortgage and council tax. I have 18 days before my bank account is emptied again, and I can no longer ask my parents for help. Most of the seven lenders (around £200-500 each) are taking the full amount.

 

We've got 18 days before we crash.

 

I read the other night that cutting your plastic up will stop them?

 

I need help...

Ok, so they are taking the money out of your bank account, yes ? Directly from the account by way of the Debit/credit card ?

 

You have a couple of alternatives I would think. Ask for new cards, say that you think your account has been compromised by way of the cards. Or completely up sticks and move to another bank.

 

I then suggest you organise a budget and instill in your partner the need to stick to it. Payday Loans are a disaster.. and to be honest, if these are necessary to pay for the priority debts then you both need to do a serious rethink on your finances.

Thank you for your advice. Here's an update. I've been to the CCCS and completed their suggested debt remedy which includes a budget and list of my debts.

 

My concern is still the 6 payday loans that will be emptying my halifax account (they show as 'DC' on the statements) using my Visa debit card on payday. I phoned CCCS and asked them about what to do. They suggested writing (or emailing with read-receipts) to each stating:

I have received advice from Consumer Credit Counselling Service to help solve my debt problem.

 

I am in financial difficulties and not able to meet my normal monthly payments.

At the moment I am trying to raise money to pay off my debt with you. In the meantime I will continue to make a monthly payment of whatever I can afford until the money is available.

 

Please remove do not collect any Continuous Payment Authority payments from my back account.

 

Please consider reducing or stopping interest or any other charges on my account to help me during my financial difficulties.

 

Yours faithfully

I was also asked to send copies to my bank and ask the bank to remove any 'Continuous Payment Authority' from the payday loan people.

 

My card has the CVV that has been given to the lenders, but CCCS said doing the above should stop them.

 

Has anyone tried this tack?

Cancel your cards, NOW! then get new ones. Although this is not a long term answer it will give you breathing space. The companies cannot take monies from your accounts without a valid card. Obviously if you then don't come to an arrangment with the companies, that may have long term issues, but for a short term answer CANCEL THOSE CARDS NOW!!!

If any of the banks pay out, you can get the money returned by the bank, because they have honored a defunct card, the only way that the companies can then get monies from your account is if they have a Direct debit, or to start taking other action which can take months, years, but off course affects your credit rating.

Just been reading the loan agreements that I could find. Almost all of them can collect by direct debit it the card transaction fails!

 

No way was that intentionally signed (should have read it better!!!)

 

Can a Direct Debit be cancelled?

Yep, just phone up your bank and cancel the Direct debit, as i say you have to be aware that the companies will reg this with credit agancies, and the sooner you can come to some arrangement to pay them back the better, but if they are not listening to you they have left you very little option, your home must come first.

Can you get a new bank account, I would suggest you do that as a matter of urgency as these buggers have a way of emptying your account even with cancelled cards. It doesnt matter if it a simple cash account, it will keep your salary safe. This would be the first thing I would do.

 

Can I ask who the pdl's are with? This may help in how to go about setting up payment arrangements.

I would have thought someone with debt probs can only open a basic account unless I'm missing something!I've got a repayment plan set up with all 5 of mine (in all took about 5 weeks from 1st contact with the last one to agree a plan) and I've just had 2nd batch of monthly repayments out this week with no probs they are not all so bad as long as you don't ignore them and do let them know your having difficulties making payments as soon as.If your that worried maybe invest in getting a pre-paid card (terms will apply tho and there will be a minimum loading amount)and never approach another payday loan company or apply for further credit to pay of the ones you currently have

Right some of mine too

 

Lending Stream .. should be ok - do not let them 'disappear' would be my word of advice seeing other threads, may try to get you to re-loan

Think I've asked myself once before if they differ to the average payday lender considering their loan durations are that bit longer in some cases up to 6 months?

so not sure where the one month plus loan amount comes into it

I had a loan of £200 just shy of £500 total repayable even before having charges applied

 

Quick Quid - will provide plan over 3 to 4 months only

 

Payday Express - After huff and puffing will agree to repayments

not sure on a set duration with them as I have to have review in 5 months

 

One of the others (a major PDL lender) I also had agreed pretty much outright to a 12 month plan so can be done - though on some I did need to provide details such as statements, income and expenditure details, amount of debt, other creditors details even !! but I did find it helped personally.

WDA were very good with us, they set up a plan without a problem. Sent email before I defaulted and plan was set up within 24 hours after a few emails.

 

In terms of bank accounts, many offer basic accounts, such as co-op, they may be worth a shot.

 

You really need to get working on this as soon as poss to avoid having your wages disappear!
