      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello group,

 

Not sure where to take this, I got on contact with one of the companies advertising ppi claims at the top of your page. I now wish I hadn't.

 

I filled in forms for 3 credit card fees and 3 PPI claims.

 

The first said there were no fees, fair enough!

 

The second refunded £55ish, took it straight of my arrears. (fees claim), leaving me £28 to pay, something that is affordable.

 

The third, no reply yet.

 

My worry now is that if I do win (obviously I now wish it won't) the PPI claims will they offset it against my arrears, I am really worried about this as my only reason for claiming this was to attempt to reduce all of my debts and I am more worried that I will end up with new debts because I will have the company's fees to pay as well.

 

Is there anyway if I win that they would let me pay the fees and offset the rest.

 

I struggle from month to month and am once again on the verge of tears all the time, just when things were starting to settle, the trap starts all over again.

Sadly the banks do have the right of set-off but against arrears only.

 

The figures for refunds you mention sound small...are you sure you have received the correct amounts back? Have you done any calculations yoursefl?

 

Can you give us details of other debts as we may be able to advise as to what you can do about them to take the pressure off you.

Thanks for replying.the figure was small cos it was a fees claim. I do not even know if these cards had PPI when I set this route in motion.I did not claim for the cards with CCJs as the person told me they would offset it against these. All my debts are in arrears and I have manageable payment agreements with them, if these get settled I will end up with more debt which I didnt need.All I can hope now is there was no PPI and I'll just continue as I am stressed but just about coping!

God it grinds my teeth. We wont claim on the CCJ as it will be offset against that? So if you owed £1000 but had £800 in PPI they would not claim.

 

Ive started on the road and though I was good with my bank charges claim, the help in the PPI section is excellent so go for it yourself.

 

I would like to ask the brains, IS they CCJ questionable as the amount will consist of missold PPI?

Whatever I post is my opinion and should be taken as such, an opinion. While it is what I believe and is offered in good faith, it should not be taken as a statement of truth

Possible grey area IMHO. Perhaps ask the question in Legal Issues Forum. This could also apply to other unlawful charges, not just PPI of course.

Thank you, I do intend to persue the PPI on the cards which have CCJs as I have recently found statements and there is definitely some PPI on them, I will have a good read and use this forum to start this myself, I wish I had never used this company, they just pray on people in these situations.
