How small can a claim be?

Last month my DD for the minimum payment to my Egg card failed. I knew this was going to happen and paid the account by alternative means by the date due so the account was not in arrears. Egg still charged me £20 for the failed DD. I have sent them several secure messages about it. Their latest reply:

 

The reason that we charge the £20.00 fee is due to the cost of administration, requesting the payment, having the payment returned and then re-instating the direct debit afterwards.

 

Therefore the charge that has been applied to your account is correct and justified.

 

I now want to take this further but together with a previous charge of £20 this only amounts to £40. Will they take this seriously if I say I'm going to claim for such a small amount?

I would imagine that it doesn't matter much at all really. At the end of the day the money is legally yours, at this point in time theirs two ways of looking at it..

 

1) worst case scenario, they don't take it seriously until after you've started court proceedings, in which case they'll pay up for sure.

 

2) They may think for the sake of £40 it'll be easier just to pay up!

 

I really can't see them ever going to court for £40. just doesn't make any sense!

 

 

Just follow standard proceedure and i'm sure you'll be fine!

£40 is fine. Have you an alternative account? Get one. be ready.

 

They appear definitely to have committed themselves that the charge is a pure penalty.

You could write to them and ask them for a more clearly detailed breakdown of the costs of each part of the transaction. You shoul point out to them that if there claim as to charges cannot be verified then their letter could be viewed as a misrepresentation or worse by a court of law. therfore you ask then to reconsider very carefully whether they wish to amend their previous statement in anyway.
