Hi all. Im fairly new to this site and this is my 1st post. I bank with the Bank of Scotland and am currently at the moneyclaim stage of claiming back about £2500. I have used a friends address in England(on my parents advice who have just successfully claimed back over £4000 this way) and so far the BOS has entered no intent to defend for my claim. They have until the 27th Sep to do this. At the moment I am extremely nervous that the banks are going to start challenging the claims in court and Ill end up having to fight them there. Can anyone advise if they think this is going to happen soon or should I stop worrying? Thanks in advance.

MC- filed 8/9 Deemed served 13/9

SETTLED IN FULL-9/10

It's unlikely but it could happen, so you have to be prepared.

Halifax joint a/c (£3800 charges + £40 interest on charges over 11 years) - paid in full 23/06/06

Halifax joint a/c new charges £1100 - LBA sent 02/08/06

Halifax 2nd a/c (£1500 charges + £150 interest on charges) - partial payment received 13/07/06 (no s69 interest) - AQ filed 07/08/06 - Court awarded 50% of s69 interest (Bank didn't turn up!)

Halifax Visa (#1) Data Protection Act sent - statements arrived - £350 so far

Halifax Visa (#2) Data Protection Act sent - refunded £170

Im trying to claim £1400 from the royal bank of scotland, its been 12 days and still no news!!

 

Im thinking the same way as yourself, are the banks just going to stop all the refunds before i get chance to try and claim mine back.

 

Keep me posted and il let you know how i get on.

- Rang asking for statments 1st Sept 2006

- Received statements 8th Sept 2006

- Sent prelim letter 11th Sept 2006

- Received polite NO from T.MacLean 20th Sept 2006

- LBA sent off 26th Sept

- Received letter 3rd Oct, another polite refusal

- Court Action - 10th Oct.

- Claim Acknowledged - 20th Oct

- Defence Filed - 15th Nov

- AQ requested and lett filled in and sent back - 20th Nov

*Copy of Cobbetts AQ filled in asking for even more info??....*
