      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

It seems that all my chickens are coming home to roost at the moment. I suspect that checking my credit file a few months back has stoked the hornets nest. Anyway - Lowell own an old Egg Card debt of mine. Yesterday I received a letter from Freds demanding payment and stating that I should no longer deal directly with Lowell. Should I treat this as a fishing attempt or is in now inevitable that litigation will be initiated? Am dealing with other issues right now so hoping I can revisit this one next year....

Your checking your credit file will

Thanks Brig. Considering that Egg sold this debt, is there any reason not to send a SAR to Egg so I can understand the balance and charges? i.e. Would Egg pass on the fact that I sent a SAR to Lowell/Fredricksons? Don't want that for obvious reasons...

send them a "CONFIRMED PLONKERS" red card in response.

 

Yes, send a SAR to Egg. It might throw up something, and with Egg you may be surprised. PPI, unlawful or excessive charges, correspondence sent to an incorrect address, consolidation loans which may be multiple agreements - lots of stuff for you to potentially dispute the account about - and that in turn will help you shake off Freds.

Today I have received a Letter Before Action from Freds giving me 7 days to respond or else they will take further action.

 

Sent SAR to Egg yesterday which will take up to 40 days to come back. I want to see this as I have no idea how they arrive at the figure they are claiming and there could be charges and even PPI.

 

Is there anything I can do to stall court action? Perhaps a CCA request to Freds????

 

Would really appreciate some advice here! :-)

What a shame - this one was about 10 months away from being SB'd but I guess that's why they are acting so swiftly!

Envelope ready to go to Freds once I have got a PO for £1. The hope is that they suspend collection activity while they retrieve the document(s) and that my SAR to the OC (Egg) comes back in the meantime. The aim of the game is to arm myself with facts. Is it worth sending a SAR to Lowell and Freds in addition to the one sent to Egg?

You mean sending SAR to Lowell & Freds too? Or see what comes up with the SAR to Egg and CCA req to Freds?

Well SAR has already been sent to Egg. CCA has been sent today to Freds but it says that they should forward if they feel that they are not the creditor so hopefully that is enough

Freds have replied to CCA request saying that they have 'referred the matter to their clinet' (Lowell) and have 'placed the account on hold'

 

So the CCA request has had it's desired effect. Will send a dispute letter after 14 working days (12+2). This will be on 3rd November

 

Egg have until the 23rd Nov to reply to SAR.

hmmmm, had a response from Egg today headed 'Your request for a copy of a credit agreement' and saying that I need to send them £1.

 

I didn't send them a CCA request, I sent them a SAR. AND I enclosed £10 postal order.

 

What are they palying at?

 

I am seeting here!

 

Is it worth calling them or not advised?

sent them a letter diputing what they say and stating that the request was a SAR and that I had enclosed £10 PO. Told them I expect them to respond within 40 days of my original request

Right - quite a surprise this - big fat envelope from Egg arrived today with my SAR response (despite the above nonsense!). So a very quick SAR response!!!

 

Anyway - debt is about £1700

 

Charges and PPI on account amount to £500 from early 2004 to early 2006.

 

Interest rate appears to have been 16% apr

 

If you take the best case scenario, the charges + interest add up to less than the £1700.

 

What is my best course of action?

 

I would happily pay a fair amount to settle this?

 

Not sure if they'll play ball but I'd love to nip this one in the bud so am hitting the triangle!

Hi Mr Hat,

 

Have you used this spreadsheet to list the default charges - http://www.shweb.pwp.blueyonder.co.uk/interestcalcs.xls You could use a nominal rate of 24.9% to claim interest in restitution on the charges.

 

Use a separate sheet of the same spready to calc the PPI.

 

See what the figures show as a possible reclaim.

Agreed.

The FOS have come down heavy on those who have dragged their feet on PPI claims.

There is no way they will give restitution as a matter of course.

You have 2 options then-ask Egg to sort the PPI out with stat 8% or tell them you will go to the FOS.

Ask them for compound and if they refuse take it to Court.

Either way-make sure Egg are aware that there is a dispute as well as the DCAs chasing.
