The MP, who is one of Rishi Sunak’s trade envoys, is also said to have called his 78-year-old former campaign manager at 3.15am one day in December, claiming he was locked in a flat and needed £5,000 as a matter of “life and death”. The sum, which rose to £6,500, was eventually paid by his office manager from her personal bank account and subsequently reimbursed from funds raised from donors   "According to a source close to Mr Menzies, the MP had met a man on an online dating website and gone to the man’s flat, before subsequently going with another man to a second address where he continued drinking. He was sick at one point and several people at the address demanded £5,000, claiming it was for cleaning up and other expenses."   Hes supposed to use funding from Taxpayers and doners for a life of service, not funding a life of drink and debauchery Hope his parliamentary expenses are also investigated.   In fact, perhaps Mr Bates next role in life should be as an independent investigator of Parliamentary expenses?

    • We both sent our completed N181 form to the court and claimants solicitors. We haven't received anything from the solicitors yet but perhaps we will today. How are directions agreed ? Does the claimant file proposed directions with their Directions Questionnaire ? I will update once anything is received from the solicitors.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

My court date is 26th March, next Mon, after a reminder they sent me an offer today, so I wouldnt expect anything to soon. they seem to be making offers about one - two weeks prior to the date.

My court date is the 8th May so only just over two weeks to go. No word yet from Barclays but from reading the threads they seem to leave it till a few days before.

I am writing to you today after receiving my date for the court hearing to recover my charges imposed on my accounts.

Claim Number: XXXXXXXXX

Court: Skipton County Court

 

As you are already aware, Barclays have no intentions in attending these hearings and the Judges around the country are realising this.

With this in mind, I propose that, so we dont waste any more of each others time, and the courts, we discuss the matter of settlement out of court.

You will also be aware that claiming interest under section 69 ....... this is increasing on a daily basis.

 

As at todays date the amount being claimed is £3,825.55.

 

I am willing to cancel all proceedings against Barclays if this figure is agreed as the settlement figure to be paid into my bank account.

These funds will be used to reduce/clear the overdrafts on my accounts.

Hopefully, you will see, I am not doing this to gain financially, simply to straighten my finances with Barclays.

 

May I add that, taking this course of action to recover my charges does not reflect any disrespect I have for Barclays and I intend to remain a loyal customer for many more years.

Sent the message to Krysta on Saturday and no response not even an acknowledgement they have the email have sent it again today if no response by end of the week will give them a ring on Friday and try to get the money out of them

Just been reading your threads, cannot believe it's been going on so long.

 

Really need some advice, trying to claim back charges from Barclays, LBA deadline is on Thursday and have heard nothing from bacnk since they sent me a letter acknowledging my first 14day letter with their usual ' we wil repsond to you in 8 weeks according to the FSA rules'. i called them on tues stating that I would have no choice but to file a claim on friday and they said sorry but reiterated the same rubbish as in the letter above. Do I file a claim on friday? or can I wait until monday, if so will delaying it hinder my claim?

Sorry I havent got back sooner been away with work.

 

They are the worst to deal with, no doubt someone will come back and say their bank is harder to deal with, but Barclays are hard work and will take it to the bitter end as they are busy with loads of claims.

 

Stick it out and you will get your money, your date is the 8th, in my case they didnt send an offer 'till I phoned the name on the court sheet 6 days prior to our court date, two of those days were sat/sun.

 

He said an offer would be in the mail, it arrived, we had made an error in the interest, I phoned, he agreed the amended fig, money was placed in the Barclays account the following day, which was the Thur prior to a monday court date.

 

We posted a letter tothe court on Fri, I guess they got it Mon morning.

 

So please play their game and wait till you get a little closer to your date and then phone the name on your piece of paper.

Stick to your deadline you gave them 14 days if they have not responded then file the claim delaying your claim will not hinder you but if you do stick to the dates then they know you mean business

Thanks Conni. By the looks of things Barclays play hard ball, i'm just a bit apprehensive about filing a claim. But once i've done my research i'm sure i'll be fine!

Well phoned the bank on friday to check my balance and low and behold Barclays had put £350 in my account without me knowing as a good will gesture! So I am going to write them a letter saying that I will accept it as part payment, ONLY if they refund the full amount due to me, if they don't to remove it from my account and that I will file a claim. Is that correct?

This is unusual for Barclays to do this, I know they do it when settling the Additions disputes but not on charges.

Well I rang Barclays and spoke with Krysta she said she had passed my details onto a Paul Quinn telephone number 0207 116 5634 who was working in date order and was only dealing with the 6th May court dates today so if my maths are right a letter should come out to me on Thursday and could I call him back if I had not heard from him by the 30th April.

 

He sounded very fed up and told me they were inundated with emails and letters at the moment I wonder why!!!

Did feel a little bit sorry for them but when I saw the news of how much money they are spending alamgamating with the Dutch bank it went right out the window.

Thats the same chappie that I had, seems a decent bloke and was helpfull, even when we had to re-calculate the interest in our favour as we had made a mistake.

 

I phoned him 3 working days prior to the court date and agreed the fig, letter for me to sign was delivered the following day. The cheque followed on the day of the court hearing..

Hope my cheque arrives a little sooner than that as the post comes after I will have set off to the court as my hearing is set for 10am so will not be able to cancell it maybe I will give him a ring and ask him to send the money electronically then I will have time to cancell the hearing.
