My mum has a santander card, which we done the SAR, and then requested the charges back. They refused, and have now issued a court claim for the money. What can we do?

Hi lesley

 

Ok you have 33 days in total once issued with a summons (5 days deemed served leaving 28 so 14 to Acknowledge Service (this can be done on line MCOL using your password and user name on the summons) and to defend all you have a further 14 days to submit a defence and counter claim.

 

In the meantime you should request information pertaining to their claim via CPR and a copy of their agreement via a section 78 request for the CCA.

Do this asap.In the meantime if you could post up details of the Claimants PoC (statement of claim) verbatim less any identifiable data.
