hi all, i have recieved a letter from HFO today 27th sept, confirming receipt of my CCA letter plus £1.00 payment, they state that they have ordered relevant documents but this may take up to 12weeks due to high demand.

Where do i stand on sending the account in dispute letter if i don't recieve documents by the 30th sept which is the deadline date if they have acknowledged my letter?

The letter also states that they have stopped all collection activities on the account, one thing i have noticed is that the HFO case number has changed slightly does this mean anything?

It had NADN5 at the end before now it has CCA at the end?

Is there any exceptions to this as they do own the account and its clearly states on the letter "we have today ordered the relevant documents from the original lender and once recieved we will then send them on to you."

Also what happens once i've sent the dispute letter? Do i just wait and see what happens?

No - the law states they have 12 days + 2.

 

They have not as yet complied with the law so the account is legally in dispute. So send the letter. They can not enforce the debt while they fail to comply.

 

The fact that they are trying to comply, or may comply in a few weeks is not relevant.

 

As an example it would be like stating that they had carried out licensable activities without a Consumer Credit Licence, which is a criminal offence, but they intend to get a licence in a few weeks time. :-)

Well I have had the EXACT same letter today as Russ, stating they have to request the documents from the original lender which, due to high demand may take up to 12 weeks. In the meantime, all collection activity will stop.

Just goes to show how many accounts they must be trying to collect without even having the original paperwork, which I assumed they would have had already!?

Hi all, I have a similar problem with HFO, its a long running battle really going back 2004 regarding a loan from Welcome.HFO came on the scene in 2008 and sent me their usual logistic card! Hurrah! since then its been a nightmare.I made a critical error of paying them some amount towards the initial debt of 1,500 had swollen considerably to about 2,500 or something by the time I made a payment.I then decided to see if the company was legit and to utter horror I realised that I had just compounded my problem.So I CCA them , they didnt reply or acknowledge my letter and I sent two more reminders which they ignored, all this in Nov 2008 right up to Feburary 2009.In between I recieved a call from the HFO office thanking me for making a 1 pound payment towards my debt, and that was when it dawned on me that they were not going to play by the books.I have not heard from them since the last default letter I sent them in 2009 and now agaian I am receiving litigation notification letters and progressively too, the last one is SCHEDULE OF LITIGATION LETTER.Any advice will be most welcome.

Ok i have had a response from HFO, they have only sent me a printed copy of my signed credit agreement and none of the actual t&c's. I have also noted that they must have got this off of a server of some sort and that at the top of the document it says page 2 of 8. Seems to me like they are hiding something? I have read the agreement through and can see nothing in reference to another company charging me interest.

Can you scan and upload what they have sent?

 

dont forget to remove personal details and account numbers etc.

 

Are they now saying they have complied with your request?

 

If they have not sent you any terms and conditions then they have not complied with your CCA request. Have you sent the account in dispute letter?

CCA and accompanying letter sent after i sent dispute letter. Note web address and amount of pages at the top. what do i do now as it obviously doesnt say anywhere on my cca about them being able to charge and the haven't sent me any t&c's?

If they have not sent you a copy of the terms and conditions they have not complied with your CCA request.

 

Nor have they sent you a statement of account.
