I actually CCA'd Westcot who were trying to collect one of these debts in 2007 and they handed it back! unfortunately I have misplaced all the paper work since then, if I SAR Westcot would they send me the correspondance?

OK, that is only true surely if the creditor defaults the a/c immediately since a default, regardless of its registered date, remains on your file for six year. Im my case, i stopped paying a debt in 2005, they defaulted the account in 2010, default will fall off my CRF in 2016? Is that right?

 

a default DOES NOT RESET THE SB DATE!

 

an account will TOTALLY vanish on the 6th birthday of the late payment/use by YOU.

 

NOTHTING anyone else can do [barring a CCJ] can reset it!

Thank you dx, im aware of that, the point i am making is that in the event that a creditor defaults the a/c 5 years and 300 days after the last payment, then that default will remain on your CRF for a further 6 years, the fact that the debt is SB'd is inconsequential.

It will only stay on your credit file if you let it. It clearly should not be there, for all the reasons discussed.

 

Only you can get it removed by making the complaint, under threat of legal action. Google “kpohraror v woolwich building society”, pass go and collect £1,000 if they do not comply.

Cheers for the info!! Im also having a battle with VW finance similar type of story, gave the car back in early 2005, then stopped making payments in May of 2005. My credit file today still shows a 'special instruction date' of March 2008, with the account still showing as running and that im constantly late making payments. This is impacting my credit score significantly and Experian have agreed to contact VW to make enquiries. Again, this debt is SB's so should not be showing on there at all.

Im actually wondering whether or not I have a leg to stand on here as the DN (i assume) was sent to the address i used to live at in 2005, i moved in 2006 to a different address but didnt notify anyone except my bank although i did start to receive mail regarding other debts from various DCA's all of which were sent packing. I also have a couple of CCJ's which were issued to me in 2006 again at my address i lived at in 2005, theyre due to drop off in Feb / March next year - was considering challenging them but is there any point?

it matters not how many DN's, defaults, late/over or WHATEVER markers or info a creditor places on an account

 

THEY WILL ALL VANISH .. SO WILL THE ACCOUNT,

 

after 6yrs from the last ack by you of the debt [this could be a payment/use or ack letter]

 

a default will not stay there for an extra 6yrs! it cannot stop the ac fro m going SB

 

if you have any accounts showing still that ARE more than 6yrs old since ack

 

you need to complain to the CRA as to why it is still showing.

Sorry dx, I meant they do not go away, ie. the judgment still stands and it does not become SB.

 

in effect ofcourse it does become sb'ed

as we welll know

it takes a very very good reason and a lottery judge to re-activate it

 

they must have a very very good reason

 

extremely rare

esp if it is not the oc

Correct the DN stays for 6 years then is removed

after the anniversary paid or not as DX says if no

payment or written ackcnowledgement has been

made in that 6 clear year period the debt is stat barred,

the default will stay if it has time to run but I have never

failed to get deafults removed for people whose debt

become SB prior to the expiry of the default.

Please aware to get this done you must contact thr

creditor that placed the default NOT the CRA in the first

instance, but copy them the correspondence to them.

COMPLAIN TO THE COMPANY THAT PLACED THE ENTRY NOT TO

THE CRAs, they cannot remove or amend the entry without

the company giving leave.

it does not matter when a DN is issued

if the debt goes SB'ed then it falls off the CRA file..wverything with it vanishes

 

a DN cannot reset theaccount SB date.

Sorry to disagree dx if the debt becomes SB the default

remains as long as the debtor does not challenge it, much

the same as SB debts must be notified by the debtor that

the debt is SB ,and they will not be paying. the debtor must ask

request the removal of the entry once the debt becomes SB if

the DN has time to run.

The SB date and the default date cannot mutually extiguish

each other.

No indeed not but if a debt becomes SB while a DN

has time to run the debt will not disappear because

it is stat barred, it must be challenged

to get it removed but the point is the debt still

exists SB or not so the DN can remain unless

challenged.

but if it dropped off the op's cra file due to 6yrs of no payment etc etc

then it cannot harm any credit rating or future credit

Exactly, everyone needs to be aware of this, and if the individual

knows of a defaulted debt that is near SB then it is wise to check CRA

files around one week before the SB date and on week after.

Also if the entry is on Equifax it may still appear on the last archived

report you would need to buy a new report if you are not a subscriber

before it will show it's removal.

Thank you all so much for your assistance I am now clear with what I need to do. In the meantime what would be the best way to find out exactly when the last payment was made on a debt ? SAR them?
