      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, I'm about to defaut on a Wonga loan (£500).

 

Ignoring any charges and further interest they try and wack on top, is it possible to arrange a payment plan with them over 12 months in writing or email? I don't want to phone them.

 

Also been reading on here about having to send them an expenditure sheet, not really comfortable with that, is that something they demand? I have no way of proving my income as I work for myself part-time (cash).

send the same email to : [email protected] [email protected] [email protected] explaining your cicumstances have changed asking for a 12mth repayment plan. also ask for sort code account number, and ref number so you can send payments once a month by faster payments. make sure you send the payments as well, oh and ask them to stop interest and charges.

 

Just send a simple straightforward email, and within a cpl of hours you will have an eail confiring the repayment plan.........

They are very good i owe £680 and they have set up a repayment plan over 6 months no added interest or charges.

Good stuff, I'm hoping they will let me do 12 months without interest or charges. I don't think I could afford it over 6 months.

They should do, they did with me but then passed onto Gothia one month from the end.

Hi Bedonde,

 

I am in pretty much in exactly the same situation...my Wonga loan is about £630 and I shall not even be close to paying it off this month or the next.

 

Doing some research but will probably set up a repayment plan over 12 months also.

 

I am due to repay on Tuesday 11th October...let me know what happened in your situation.

 

Anyone else who has any more advice...it is much appreciated.

Thanks Maria, unfortunately I don't really want to have to wait a week for it so presumably they can just call me up using my name and address?

 

I currently have a plan with them at the moment over about 8 months and I just sent them an email telling them my situation, you might have to keep chasing them to set up as I did but they do freeze interest and charges once the plan is in place. Make sure u have your money paid into a different account though as you cant set up a plan until you have defaulted with them.

I never use my bank account, well rarely - probablly not worth changing it. So I need to default with them before notifying them? I thought it was better to let them know before I default?

Got an email back from them, they are not willing to do it over 12 months, they said 6-8 months.

 

 

I would prefer 12 months, as it's more of a realistic amount that I can definately pay. I can't see them backing down however, so think I will just let them take me to court/send out debt collectors.

Hi Guys, did you still had to change bank/debit card or would you trust Wonga to take only what you've agreed on repayment plan and not the full amount?

 

If you use your account for wages, then you need to change it.

 

I personally don't really use the account that Wonga goes through.

hey, email all the email addresses and [email protected]. They should let you do it for 12 monthes i owed just under 600 and mine was for 14 months!! X

 

Thanks! Tarik seems to have accepted my offer of 12 months, but I'm a little confused.

 

I recieved an email from him this morning with some mistakes in it (presumably I just ignore), for instance they said the repayment start date was 12th march 2011 but the chart below had the correct start date (30 nov) for first payment. He had given me the details for payment, but it said "standing order", so does this mean I pay using my account still? Or do I just pay it in via his bank using the details provided?

 

I logged on to the Wonga site, which has a section to show my new payment plan but do I need to agree this somewhere or is it just official as of now?

email him back explaning the mistake i think its accidental, you can ask him for wonga's bank account details and pay which ever way you like, ypu do not need to give your account details. Everyting should be set up now and it should show on your wonga account page. As long as you agree with it and send a email saying you agree it will be in place. Just remember to try to keep up with the plan as it will stop them from adding interesr etc. Well done! X

I've already got Wonga's bank account details but from what I gather everything is set up as a standing order, so they will still try and take these payments from my account. It says if the money is not in there when they try and take it out, then they will scrap the repayment agreement.

why dont you change your bank account details? Or do you have a different bank account you can pay from?... This way you will keep upto date with repayments and wonga will not have access to your money

 

hi, the issue is my nearest branch is miles away, although i do drive - i would rather just pay at a post office on the day. Im not bothered about wages being in there, I dont get payed into my bank. I guess ill email them but it looks like everything has already been setup.
