If you have been successful in your claim with Abbey but the thread title doesn't show **WON** or **SETTLED** can you please send a private message to one of the mods to change the title and put it in the successes sub-forum.

 

This will give other users an at-a-glance guide to other cases that have been won and may just give them that extra little bit of confidence needed to pursue Abbey themselves.

 

If you can't PM a mod for whatever reason then just reply to this thread.

Hi All,

 

Just to give anyone still awaiting their claim a bit of a boost - I had a court date re Abbey on 11th of this month. I received a letter from the Abbey this morning to say they will SETTLE IN FULL. This includes the court money I had to pay and the 8% interest added making a total of £3611.50.

 

Just waiting for them to pay the money into my bank account now and I will make a donation to this site - what a FANTASTIC site. Many thanks.

 

So keep at it - it really does work!!!

Fantastic news... Jobs a good'un then.

 

Just a quick question.... How long after you started the cclaim in the court did it take? Abbey have to file defence by 16th of jan for me (they havent yet and its only a day away. Just want to know so I can plan ahead for any eventuality.

I have a hearing date of the 16th Feb. I sent in the AQ and asked for disclosure but the Judge does not appear to have ordered this. In cases where Abbey paid out was it because the juge had ordered disclosure?

For anyone worrying about going to court, don't worry! I was a bag of nerves waiting for my court date this coming Monday. Arrived home to a full settlement last night! They haven't got a leg to stand on, so keep going! Just make sure you follow the step by step instructions on this site and get all your bundle sent off to the Court and a copy to Abbey and hey presto, just sit back and wait. :D

please send them a data protection letter, with a payment of £10. you can go into your local branch with it but make sure you get a reciept. i sent mine on the 11th of jan and i recieved all mine including the micro fiche ones yesterday!!!! along with letters saying they would be in the post within a couple of weeks!!!! go figure eh!!! you will find the letters you need in the library on this site, you are protected by data protection if you do this and should get them back with in 40 days.

i just received a letter telling me they cant send me my statements cos they all been put on micrfiche, quite funny as they actually arrived yesterday. have now sent 1st letter so will wait now and no doubt they will send me a standard letter like they have my other half.

Got a letter from Abbey this morning

no 50% offer just 100% + costs !

The Johnsons -v- Abbey Est Claim £2500

14/06/06 Request for statements over 6 years sent

28/06/06Received 12 months statements with Microfishe excuse

19/07/06 Sent Microfische Letter

24/7/06 Rcvd 2nd Fob off re Microfische from Pam Speed on 40 day limit.

01/08/06 Prelim letter for refund based statements (£1993.00 + interest) and estimated £3000 + interest for missing statements

14/08/06 LBA sent !

17/08/06 £680 refunded to my aco**** with no explanation -

24/08/06 LBA sent re Non Compliance S7 Data Protection Act

1/9/06 Abbey complaints refund letter received and ignored preparing N1

7/9/06 All microfiche copies received. Preparing N1

14/9 revised LBA sent

03/10 Litigation commenced

AQ 17/11 AQ returned

15/01 Statement of Evidence Lodged - Abbey Have until 12th Feb

Court Date Scheduled 21st Feb

Thanks for the reply, Still no sign of Abbey settling, It has been about 5 months since i first sent out the statment to Abbey regarding how much i was claiming back + interest. How do i send them a revised statment showing the new interest calculation to date, since i have already filed a claim for a certain amount, can that amount be adjusted at any time ?

YEEEEHAAAA. Ive just had a letter through the post this morning. Abbey are settling the case out of court, paying back the full amount + Interest + Court costs. They also said that this settlement means that i cannot hold them responsible in any way?? "Whatever, the mere fact that Abbey are paying back the full amount means they are responsible! ". It feels good to win against the big companies :)
