    • Thank you for your reply, DX! I was not under the impression that paying it off would remove it from my file. My file is already trashed so it would make very little difference to any credit score. I am not certain if I can claim compensation for a damaged credit score though. Or for them reporting incorrect information for over 10 years? The original debt has been reported since 2013 as an EE debt even though they had sold it in 2014. It appears to be a breach of the Data Protection Act 1998 Section 13 and this all should have come to a head when I paid the £69 in September 2022, or so I thought. The £69 was in addition to the original outstanding balance and not sent to a DCA. Even if I had paid the full balance demanded by the DCA back in 2014 then the £69 would still have been outstanding with EE. If it turns out I have no claim then so be it. Sometimes there's not always a claim if there's blame. The CRA's will not give any reason for not removing it. They simply say it is not their information and refer me to EE. More to the point EE had my updated details since 2022 yet failed to contact me. I have been present on the electoral roll since 2012 so was traceable and I think EE have been negligent in reporting an account as in payment arrangement when in fact it had been sold to a DCA. In my mind what should have happened was the account should have been defaulted before it was closed and sold to the DCA who would then have made a new entry on my credit file with the correct details. However, a further £69 of charges were applied AFTER it was sent to the DCA and it was left open on EE systems. The account was then being reported twice. Once with EE as open with a payment arrangement for the £69 balance which has continued since 2013 and once with the DCA who reported it as defaulted in 2014 and it subsequently dropped off and was written off by the DCA, LOWELL in 2021. I am quite happy for EE to place a closed account on my credit file, marked as satisfied. However, it is clear to me that them reporting an open account with payment arrangement when the balance is £0 and the original debt has been written off is incorrect? Am I wrong?

I Know! .... someone here with a chance to sue Highview for breach of GDPR with a very good chance of winning, I was excited reading it especially after all the work put in by site members and thinking he could hammer them for £££'s and then, the OP disappeared half way through. Although you never know the reason so all I can say is I hope the OP is alive and well regardless. I'd relish the chance to do them for that if they breached my GDPR.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi guys. Reading this thread spurred me on to claim back £159 that i was owed from Abbey.

I posted my letter with all the details on Wednesday last week. Yesterday, i recevied a £32 "refund" straight to my account with no letter or nothing.

The today i get a letter reminding me of their charges etc and saying they have refunded "a charge" today and that they wont be able to refund any further.

 

What do i do now?! Any suggestions? Do i send another letter?

Well, I thought by now I would be posting here, my Court date is 5th March and still no sign of life from Abbey:(

 

I had a 50% GOGW offer ( only in full and final) 2 days after Christmas .... I think they thought they would get the offer in then as we would all be skint after the hols! I was but I didnt take it!.....They however didnt deposit the funds in my account as they have with lots on here, I replied to them that I respectfully refused their offer, but I would accept in partial payment, but no money and no reply was forthcoming from them.

 

Last Bundle in by date was 22nd Feb, but mine went to Court and Abbey on 12th Feb, 1 week early. So it's still a case of sitting and waiting it seems.

 

Hope its ok to add to the posts on here, makes me feel a bit better and a bit closer to winning ( hopefully!)

Hi, my mum's just received her cheque from Abbey today - they settled in FULL (charges, costs and interest) and sent mum a cheque for over £4770!

 

 

Go with everyone - you get there in the end!

HSBC - full refund = £647

Capital One - full refund of £220 + court costs + interest

Just found a payment by cheque, into my account for £1080.83 today(funds cleared 27th Feb) so I am assuming I have won, as I cant think of anyone else who would want to pay that amount of money into my account !!! Its £12.50 too much but I assume thats the daily interest that has been added on. Had no letter from Abbey so have to 'guess' it's from them!!!!!!

 

I almost fell off my chair when I saw it, I cant believe they have have paid me, I am sooooooooooooooo pleased, chuffed, happy you name it, I am it !!!!!!!!!!!!!!!!!!

I love this site!! I am in the process of taking Abbey to court and yesterday received "Acknowledgement of Service" stating that they intend to defend all of the claim- £3520 plus interest. This scared the life out of me (not quite sure why as I always knew there is a chance of having to go to court) but having read this thread, I feel so much more positive and confident. Thank you everyone and congratulations to all of you that have gone through this ordeal and come out the other end!!

i got directions from the judge after filing my AQ. If you look at my thread I actually put the directions on my thread the day I got them . I faxed them over to Abbey 19th Feb and then phoned Inga to make sure they had been received. She said she hoped to make an offer very soon and then she then asked questions abount the schedule. So Started talking and just gave her a daily call for update. It Worked. !!!!!!!!!!

Hi All

 

I've just joined this web site. I posted a letter to Abbey on friday (23rd. Feb) requesting a full refund of unpaid cheque charges. I used a template letter from the Martin Lewis Money Saving Expert web site. I have all the statements so I didn't need to go through the hassle of getting them from Abbey. As the amount is only £96 I would expect them to settle immediately. I have used the small claims court twice in the past and the High court once in my business activities. I had written off this amount as it is so small, but for looking at a few statements and filling in a template letter it is worth a try. They have 14 days to reply, so I'll post a message then or if I hear from them sooner I'll be posting again in less than 14 days.

 

I now bank with Barclays so if Abbey want to close the account it won't worry me. It might be useful if I could use the account again as it did pay a much better interest rate than other current accounts.

Hello I am new to this site and new to all this. Seeing your comments has made me a bit more hopeful. I am asking Abbey National for a refund in charges and although it is not a big amount I feel it is better in my pocket than in theirs.

ME (ON BEHALF OF MY SON) WON ....... FULL SETTLEMENT ..... DIDN'T EVEN GET AS FAR AS A COURT DATE

Hi We received a letter from Abbey today giving us full settlement (£1594), this should help my son pay some of his debts (including me).

If you read my thread you will see that it obviously helps if you live in Lincolnshire. The judge at our local court doesn't like the banks settling at the last minute. I decided not to contact Abbey direct following a conversation with my local Court Clerk, a very nice man!! He said to sit tight and basically not waste a phone call as evidence at this court had shown that the banks can't meet the directions laid down and have to settle. He was right, bless him. Also they probably wouldn't speak to me as I am not the account holder, even though my son had given me full authority to act on his behalf.

ANYWAY .... THANKS TO ALL WHO ENCOURAGED AND HELPED ME ALONG THE WAY, ESPECIALLY ANNEY, SHE'S ANOTHER MUM AND A PENSIONER LIKE ME ..

I will keep reading this site, I can't really advise but I can ENCOURAGE.

Will let you no when money arrives.

I recieved settlement in full this week (donation due). abbey rep tried all sorts of shenanigans to get partial settlement agreed full settlement two days before court. Tried to get me to settle then but I insisted on an adjournment until settlement reached my account yesterday as i did not want shabbey pulling any fast ones. they really are slimey in their dealings even when caught with fingers in accounts.

 

In any case got my loot back:) thanks to the help of CAG team!

 

Next stop the woolwich for an even larger sum!

 

By the way good luck to anyone taking proceedings in N Ireland courts! They weren't too many stories from this neck of the woods previously but growing band in days to come hopefully!

Finally received full settlement from Abbey!

 

Initial claim was £745 - but was increased after they finally supplied all my missing statements to £3,100.

 

Court date was set for yesterday, but they settled on Friday afternoon.

 

I want to thank everyone that has helped me on this website - your guidance has been invaluable!

 

My donation is on its way to you.

I got my first small claims payment from Abbey on 28th January of £941 which they offered me the date before the action went to court. I now have the next court action appearing in court on 18th April so hopefully that will be another £900 coming my way. At long last I feel that I can hold my head up after so much grief being overdrawn - made to feel like a criminal when Abbey was actually doing the dirty themselves.

 

Hang on in there anyone who is still awaiting the outcome - success is sweet!
