This is ficticious and has no reference to myself

 

1/ before issuing a council tax summons (liability order) do local authorities have to give a letter before action under pre action protocol

 

2/ a £50 court fee that is added to the summons,

 

is it legal if the council tax has then been paid in full prior to any court appearence as there has been no court attendance to justify this £50 penalty

 

3/ the council then add a £40 fee for debt recovery. They state that the debt recovery dept is only funded through this fee and not through normal channels.

 

4/ f the remaning liability is paid prior to any court appearence, is the £50 and £40 fees then classed as a civil debt and have no place in a magistrates court, only a county (civil court)
