      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi. I'm new to this site and need advice. I have got 4 Payday loans due to default on 31/08/11..

 

Quick Quid £675.00

Payday Express £500.00

Payday UK £375.00

Lending Stream £232.00

 

After reading this forum for the past week i have taken in all your advice- so i have reported my debit card stolen and am due to set up a new bank account on Tuesday. I have been in touch initially via phone to all of the payday lenders except Lending Stream to discuss a repayment plan.

Situation so far-Quick Quid are wanting 4 payments but will stop the interest but wanting payment via debit card.

Payday Express are wanting 5 payments but will reduce interest each month.

Payday Uk-have to default 1st and someone will ring me to discuss a payment plan.

Regarding Lending Stream i was trying to repay them on my payday.

 

But do i repay Lending Stream or use that money to deal with Payday Express as it sounds like they are a nightmare to deal with.

I have also sent numerous emails to Quick Quid and Payday Express requesting there Bank details but still no reply.

Far better to put something in writing and send recorded,rather than email,keeping a copy.

They have a duty and a requirement as holdersof a Consumer Credit licence,to respond to you,to deal fairly,and transparantly.

If they want a debit card to make payments, get one of the prepaid ones and load it with the amount you want to pay - that way they can't raid your bamk account.

Finally-just received email from Payday Express with there banking details, so will either set up Standing Order or even pop into there bank to pay.

Also good idea about the pre-paid debit card-will look into this for paying Payday uk and Quick Quid.

Can anyone recommend one??

Spoke to someone from there Collections Dept. Refused to freeze the interest but willing to reduce the interest each month.

 

I recieved email though saying that they only offer repayment plans in cases of

 

 

Severe Disability or illness (not excluding close family members)

Terminal illness or Mental illness (not excluding close family members)

Deceased (not excluding close family members)

Redundancy or Reduced hours (contractual hours reduced by company)

Spoke to Jo (female) from Collections.I wrote everything down regarding what was agreed but still waiting on a confirmation email.

But at least they have sent me there Bank details.

 

see i offered them a 6 month payment plan but they said i can't have it because i don't come under there criteria of

No, i don't fall into any of those criteria. For the past 2 month's i've been paying the interest and nothing towards the loan so she explained unable to freeze the interest but she will reduce interest each month and that was agreed on Monday.

Interesting, I only going to offer them amount owed plus interest and stick to it, they really are a pain.

If you are on O2 they do a prepaid visa debit for their customers, but there's lots to choose from if you google prepaid debit cards - remember to put UK in the search or you'll get some wierd and wonderful results

So will start to pay Payday Express on 31/08/11 but have sent another email requesting confirmation of the payment plan.

Quick Quid-not due to start til 30/09/11-just got email from them asking me to confirm my bank details for the direct debit- so there not pushing for payment via debit card.

Payday Uk-will start to deal on Wednesday-31/08/11-once i default.

Lending Stream-do i pay off or use money towards Payday Express???

Do not give QQ your bank details, there's strong chance they will help themselved to what they want ! As them for their bank details.

They could change the amount of the direct debit or change the date - I know under the DD guarantee you are supposed to be advised of any changes first, but given their reputation I doubt very much if they would do that. If you have a new bank account that none of the payday loan companies have details for, don't make the mistake of trusting them with the new account number.

Got an appointment on Tuesday to open new bank account. Don't have Debit card for old account as i reported it stolen. Also can't close current bank account as have overdraft.

I will keep emailing them for there bank details-but don't want this to go to Debt collection agency- currently looking into Prepaid Debit card.
