    • Hi there Manager for our soccer sixes team moved overseas mid season and we struggled for numbers so we told the ref about 5 weeks prior to seasons end that we would see out these games then be done and he told us he’d ’pass the message on to the relevant people’. Heard nothing, then 3 days prior to the new season beginning we were given our fixture for that weekend. Told the guy over text we had pulled out and the ref should’ve passed a message on but we were told sufficient notice wasn’t given and it needed to be in writing. I argued it’s not our fault the ref didn’t do as he said but we were countered by the T&Cs.    now being chased for what was £608 kindly reduced to £476 to pay off remainder of the season. Been sent a letter in the post from their accountancy team and told needs to be paid by Friday.   seen a lot of the other threads saying we can literally just ignore everything but im concerned about debt collections and credit score being harmed. Can anyone confirm if this all works/what we should do?   thanks
    • Hi,   I have given an official police witness statement for the prosecution in an upcoming criminal court case, and I am very anxious about what might happen.  Specifically regarding being cross-examined.  My statement is very short, and only a couple of paragraphs long, regarding a conversation I had with one of the victims.  I have tried to research online about what information about me the defence barrister might be able to find and use to discredit me.  I have by no means have a shady past but, I am concerned about what private information might be brought up, and as this is a case that will be in the national press as it is in the public interest.  The two preliminary hearings were reported in the papers.   I have tried to research  online what information the opposition can seek, but it is all very complicated.  I believe that they can legally access public records, but I'm not sure what information public records hold.  Can they access my medical records, educational history, HMRC, and Department for Work and Pensions? (I am a self employed sole trader).  I was arrested once, and this was unfortunately instigated by the victim in this case, so could well be of interest to them.  It resulted in no further action, however I have only discovered this week that that, in fact, this means I have a criminal record, and will be so until I am 100 (no chance)! This has really annoyed me to say the least, especially since I asked him afterwards why he rang the police and he said 'for a laugh'.  So I have started to look into applying for it to be deleted, but again, if anyone has any advice on this I would be appreciative. At the moment, my name isn't on the confirmed list to give evidence, but the detective I have been dealing with has said it is 'likely'. The names of the victims in this case will not be allowed to be reported, are witnesses fair game for the press? I really need no know how deep they can delve in to my life so I am prepared if my character gets assassinated in front of the nation. I really wish I'd never agreed to this.   Many thanks
    • A belated thanks dx. Yes I may take your advice regarding StepChange. I am finding that I am telling them (on behalf of my Son) the true balances outstanding? They never seem to check properly in which worries me. If I was to take on myself is there another way of dealing with various debts? I have already submitted other IRL complaints on his behalf. Today I have received a further response from Quidie T/A Fernovo confirming that they will waiver all interest paid.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Yes used the spreadsheets on here for all my claims, but I expect ge money to be awkward.

 

This was out biggest PPI amount and is the only one still being paid. It is our second biggest oytgoing each month so it would be brilliant to get the loan restructured and reduced. To be honest if they insisted on all refunds going against the account I wouldn't be devastated and could use the extra money each month to either save to clear this early(should be vastly reduced) or reduce our mortgage-we can make overpayments and whilst interest rates are so low seems a good idea.

 

Guess we better wait and see, but I expect to end up in court or with the FOS-the amount is such that court is a risk (too big for small claims). Will see what their initial response is and take it from there.

Oh an another thing that annoyed me is the one time we needed the damn thing was last year when OH was made redundant, but they said the policy had ended after 5 years so we couldn't claim!!!

But we are still paying for the beep thing!!!

Ok well as I expected from other posts Ge came up with the old not us try the broker malarky.

A few more details

1) loan through freedom finance-but I believe after the initial chat they put us through to igroup and it was them who did the loan/ppi stuff and in fact the insurance was with igroups own insurance ppi as a front loaded policy.

2)igroup then bought out by ge money-loan still being paid to them

3) original docs show the insurance as being regulated by the GISC so does this mean the fos will look at it despite the loan dating back to 2003

Something else I remebered was from when we took a second loan with them 3 years later when I called igroupdirect to be told they could only do aloan after a referral from another company. I was transferred to purple loans who took the basic details then passed me back to igroup (no doubt commision all round on that one).

Think I may have done my interest claim wrong for this as it was a up front payment at the start of the loan and I worked out the percentage of the loan that was ppi so therefore the amount of ppi payment each month and banged it in the same spreadsheet off here I used for the credit cards.

Tried to use the single policy one as per the stickies above but it doesn't have enough months on it and was a bit confusing?

 

Have I done it correctly and should I be claiming the stat interest as on the sheet or just 8% as surely my payments include the interest?

 

ims21 if you are there can you advise? Looks like ge may get a bit arsy so I want all my calculations to be right before we go on to higher levels of action or (unlikely i know) they make an offer.

You can use this spreadsheet....it has 2,000 rows formatted for the calculation so should be plenty.

 

Change your personal details in the blue section.

 

In the list section underneath the coloured bits, enter each of the monthly PPI payments giving the date of payment, a description and the amount. You only eneter data in columns A, B and C for the list.

 

This is a protected spreadsheet so if you get a message telling you that it is locked then you are probably trying to enter data in a cell which does not need changing.

Basic details are we borrowed 20k, they added on what I thought was all ppi, but looking at the documents now its 2k of brokers fee and 3530 ppi.

I divided the ppi figure into the total loan and used that to divide into the monthly payment to work out the monthly ppi payment. I then put the monthly payment into the credit card spreadsheet with the 8% on top?

 

What annoys me the most is as well as being useless to us the PPI "cover" ended after 5 yrs,but we are still paying for it now and am expected to pay for it for the rest of the loan (15 yrs!!).

Ok

 

So total loan is £20,000 + £3,530 + £2,000 = £25,530.

 

Percentage which is PPI is 3,530/25,530 x 100 = 13.83%

 

So 13.83% of each of your monthly repayments is for the PPI part of the loan and it is this figure that you should put into the spreadsheet I've attached to my last post.

 

Typically PPI cover is for a period of 5 years but because they loaned you the money to pay for that single premium they attach it to the loan and you pay that PPI loan off over the lifetime of the loan.

My loan was with igroup and like you I got the same load of old rubbish its the brokers fault not us blah blah.

I remember the phone call, the broker took my basic details and came back and offered me a choice of 2 lenders, but advised igroup were most likely to lend to us given our "credit rating". I clearly remember being told "I will transfer you through to igroup for them to go through the loan details with you. It was only at the very end of the second conversation that any PPi was mentioned and it was spoken as a "fait a compli" (sp?), when queried they said you have to have PPI or you won't get a loan with your low credit score.

 

For your info my original PPI docs show the insurance was with igroup insurance and has in the small print confirmation that they were memebers of the GISC, so it can go before the FOS if you wanted to go that way.

 

I am awaiting a response to my second letter to GE before I decide which way to go, but OH is a contractor and between work at the mo so may have to go with FOS because of costs. Will weigh up and see.

Well they replied and said basically the same thing again. They insist the FOS can't look at it despite the insurance docs clearly stating they were members of the GISC at the time.

 

 

Going to refer to FOS because of the amounts and not confident with court action as yet. Will get the docs sent off this week and post with any updates.

Looking at the small print on the back of the ppi form again it states that any complaints about the policy should be addressed to sterling insurance group and then can be referred to the FOS!!

So GE money are taking rubbish, althought the ombudsman may end up pursuing the insurers the fact is that the claim can go to the FOS.

FOS now asking for further info as they say its looks like they will have to look to the underwriters. Luckily I have the original docs so was able to email a copy to them and it confirms the underwriters as sterling and the fact they were in the GISC at the time.

 

I am just wondering tho, if the FOS get the underwirters to stump up (eventually) can they get GE to restructure the loan as well? Or would the underwriters have to pay the difference to them to sort it out. Or would they give me a sum equal to the extra capital and interest we will pay over the life of the loan because of the PPI?

 

Just not sure how it works when one company is bound by the FOS and the other isn't.

Well FOS have messed around asking for further info to be sent and finally have returned everything to me saying they have sent the complaint on to sterling insurance who underwrote the policy. I now have to wait 8 wks for sterlings response :(.
