Just sending off my preliminary letter to RBoS today requesting the re-payment of £1093 worth of charges over the past 6 years :eek:

 

Couldn't believe it when I added it all up!

 

Anyway, letter sent today, so we'll see how long it takes for the 'we're sorry ... go away' letter in return.

 

Whats the chances, going by RBOS' previous cases, that this will go as far as having to file for court proceedings? Don't mind either way, as long as I get my money back :D

I made a claim for £3300 aganst RBS. I received a letter from my RBS branch offering £600. Sent a rejection letter. 12 days letter recieved a letter from Customer relations in Edinburgh offering £2100. I will send a rejection letter to this and tell them they have 12 days to supply all of it before I take court action. What I expect them to do is offer to pay in full a day before initiation of court action is due.

They take it to the wire.......but hang on in there.....and dont let them intimidate you along the way.

Got my letter from them today saying 'sorry your not happy' ... blah blah blah ...

Sending the LBA to them today, so hopefully hear back from them soon :rolleyes:

 

How many of these cases against RBS have actually gone to court? Not that I'm overly worried about doing this, I was just wondering what the likelyhood of this being settled before having to issue a small courts claim would be?

 

They have 14 Days, and counting ....

As far as I'm aware mate none have actually gone as far as the cortroom. The closest I've read was on Mairi V RBOS. She got to court but their representative offered her settlement before they went in :)

28/09/2006 - Statements received through the post. Charges appear to be in the region of £2000 :eek:

You should read some of the threads like Bigcol / willow etc in the rbs section.

Ok, after sending off the LBA letter I got a response from Mr Tommy Mclean stating "We believe that our charges are fair ..... " "and will not be refunding any of the charges applied to your bank account"

 

I've had a look through the step by step instructions, and think the next step is to issue a court claim now. Is this correct, or is there anything I should do in the meantime?

 

Not really looking forward to going to court over this, but if thats what I need to do, then so be it!

 

Edit - Just been reading some of the other threads about people getting paid out early after emailling Mr McLean. Should I be doing this before filing a court claim, or is it just going to be another mammoth case where its going to drag on?

Am watching your case as you are in the same position as me. I received my famous letter from Mr McLean today and have asked in other threads the next step, will keep you posted.

Alison/ Bry.....They must have sent the "bugger off" letters out en-masse! I just got mine (Yaayyyy!!!).

 

I now feel really special.......mine wasnt even on original letterhead, but a photocopy:(

Mine too, it looks like it was stuffed in the envelope with complete anger!!!!!

I would advise all of you in this position, to e-mail Tommy personally, as i told alison check out the letter in andrew1 thread, she seems to have done this, i e-mailed this to Tommy, recieved offer of £1500, thank him for the offer, and told him i would accept as interim payment, however i would persue the rest through the courts, re-iterated that it would be easier to settle before court action, as it would not make business sense and financial sense for this to go to court, for them. i will happily, e-mail the letters i sent, if you p.m. me, with your e-mail addresses.

According to the contacts post, his email address is no longer valid.

There have been some good results in the last week.

2 longstanding members WillowB and Big Col have both had cheques today.

 

So this is good news for the rest as they move up the queue.

No, not yet Alison. I think you only add the overdraft interest if you lodge a court claim.

 

Waiting to hear back from the legend that is Mr McLean, or else court will be the next step, and I will be adding the interest at that point.

I got an out of office reply saying he was back in the office last Friday, so assumed this meant he was back?

 

Might just copy the email to Ross also then, so they can't say they didn't receive it ...

At the moment its just the charges, only if it goes to court claim will I be claiming interest.

 

If you've gone the other way, dont worry about it too much. Lots of other people have done the same with a great deal of success (although the forum says you should only go after interest at court stage) dont want to incur the wrath of any mods, so I'll just shut up now:)

 

oops. nearly forgot. If you are going after contractual rate of interest, then you should be stating that in your claim now.

I have re-sent an amended LBA by email claiming interest on the charges that took me overdrawn, at their rate of 16% which is what we get charged!!

What the hell, they took it from me!!!!!!!!!!!!

Have also stated am happy to go down legal route as that would incur another £440 which I am happy to take from them ha ha ha ha.

Well Mr McLean, you are not going to win this war!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

After the response to my LBA saying the bank are not willing to pay up blah blah blah, I emailed a final offer to Tommy McLean. In return I was offered £695 as a goodwill payment.

 

Cut a long story short, I have accepted this and signed and sent off the slip to acknowledge this. Regretting it now, wish I'd went for the remaining £400 .. but hey ho, it's £695 more to spend on the kids for chrimbo.

 

Does anyone know if I can still claim back charges that I have accrued since I started this procedue and any which I may get in future?
