Hi

 

You mention that your PPI figure with interest was about the £1,400 mark....what is the figure for PPI without the interest please?

 

In addition, you mention that there were charges added to the account for being late with payment and/or being over your limit. I can't see that there is any figure put on this part yet. Can you let us know what the charges figure is both with and without interest please?

WFA, I have copied over conversation with andyorch and ims21 for you to consider.

citizenB they are prepared to accept 75% a reduction of £800 the miss sold PPI equates to £1.200 so a diff of £400, they are still keen to resolve the matter and settle.Its not a bad offer and if you consider mounting a PPI claim and the risk of losing the costs out way the differential.

 

From a financial point of view I personally would accept the offer of a TO providing that the figure offered is also acceptable on monthly terms.

 

He says he has this PPI at £1,400 including interest, I am going to ask what it was without the interest.

 

In addition he mentions earlier in the thread that there are charges on there but hasn't gone on to say how much.

 

andyorch, if he can quantify unlawful charges would that help him?

 

If we assume that the PPI premium without interest are around the £1,000 mark and they have offered £834 off the balance then he's only a couple of hundred quid out (ignoring interest).

 

Would it be easier for him to make another counter offer on the basis of unlawful penalty charges?...I cant see that he has mentioned that to the solicitors yet.

 

I can see why it is desirable to keep this from going in front of the Judge but is there still room for him to negotiate a little bit more off do you think?

 

Of course the negotiations are open and they are quite keen to settle from their response, although quite categorically state that only a reduction of 25% would be offered.

If you want to play with the figs ims and let me know (inc unfair charges and interest) then we could offer a further counter offer in light of this and shaw up a tighter Tomlin Order?

They may move a little but not much and I dont like defending on the basis of a weak DN,but to mitigate might be a way forward.

Hi IMS21, Andyorch and CitizenB, I so appreciate ALL your inputs.

 

In answer to the question re charges etc. The PPI payments totalled £840.00 and with compound interest £1255.00

The charges were not large - £120.00 and with interest £147.00

 

My feelings were that I should be compensated for the fact that when I was unable to meet the payments due to my business being in financial difficulty, I should have been able to have had the payments covered or the balance cancelled. After all it was called "Balance Cancellation Insurance"! I was told that being self employed I would have to be declared insolvent. What a ripp off. If I was insolvent, the recievers would have cancelled the balance anyway! Struggling to meet the payments obviously added to my hardship:-(

 

Anyway, that's my rant for the day!

The solicitors stated in their last letter that the offer applied to a full payment only, and if I wished to pay on monthly terms, then this would be against the full balance and costs!

I do not have the means to pay the solicitors asking figure. In fact it would be a struggle to find the £1000.00 I offered!

 

As the solicitors have not mentioned PPI compensation anywhere in their communications, perhaps I should make an offer of monthly payments and persue the PPI compensation directly with Santander?

 

Additionally, should I be arguing that the DN is unlawful?

 

I look forward to your responses.......

Considering your PPI figures why not try to negotiate the figure as a monthly payment....they can only refuse, but if you dont ask.....
